Hi gp111,

Is it possible for you to post the similar information about the number of NON-RIR cases recieved by CA state from April 2001 to Dec. 2004?

I'll really appreciate?

My attorney has 4 cases from CA which were problem cases RIR from April/May 2001, none of these cases have recieved any NOF or Approval. If the Dallas DOL is working on April 2001 RIR cases then there should be some movement. One of this cases have a PD of 1st April 2001.

Auto remanded cases go to regular queue. There are lot of people from my company who filed in may- aug2001 in RIR, CA, got remanded to state, they did not get any 45 day letters yet.

Did any ONE of the Remanded cases get a 45 day letter??

Question for H1B extension

Hello Guys,

I highly appreciate if any one answer for these questions.

I am with company X for 5 years and I am in 8th year H1B extension because my labor is pending more than 365 days and filed by company X.

Now company Y bought company X and company Y asked us to move all employes to another loaction (out of state). Closing this loaction..

Now my company name also changed to company Y name

1. what is the current status of my H1B?? Is it still valid??

2. In future can I get another 9th year extension?? H1B extension is depending upon my labor. But labor is state specific. If I move another state my labor is going to invalid. If this case how can I get another year extension??

3. Is my labor valid?? because my company name changed to company name Y.

My company people asked to lawyer. But he didn't reply. (may be he is looking for laws)

Meantime I am totally confused and tension... What should I need to do??

1. Your H1 should be still valid, Ask company 'Y' to give you and other 'A letter of Acquisition' that is, Company X was acquired by Y on Date...... .
I know this for sure as the company I worked with was bought by big blue and I travelled to India on company X h1b and just had 'Y' company acquisition letter when I came back to USA to show to Immigration.

2. Once you have that letter, 'Y' can file for your 9th year extension.

3. I am no sure on labor part, As 'X' company had filled Labour on my behal but it was not yet approved, after the acquisation, I had to file from fresh. But if you LC was cleared then that should not be a problem. I am not sure on these, hence please check with more people (Lawyer would be the best resource)

Each BPC is staffed with approximately 100 personnel (including contractors). To date, the BPCs have focused primarily on data entry of transferred cases, but are now beginning to conduct substantive review of these cases. Substantive review for regulatory compliance is required before DOL may issue a decision on the application. Supplementing the efforts of the BPCs are the satellite offices of DOL in New York, Boston and San Francisco. DOL reports that these offices will process the cases they have retained until January 2006

I have still not recd. my 45 days letter yet.I have the new case # but no 45 day letter yet. Do you think that I should go for perm?

Gurus, Is this possible

Hi Guys,
I met an old buddy yesterday after a gap . He said he applied from Texas as regular case in November 1999 but has still not heard anything on his case whatsoever. He says that twice his lawyer received a letter asking if they want to persue the case and both times they replied in the affirmative, but still no request to further proceed in the case .
Is this even possible a 11/1999 case still awaiting instructions to advertise ?

He also said that every time he files annual extension (he is in 8 th yr now) it costs him $ 3,000 or so. Is that reasonable ?

I wonder what the record for extending H1 is , has anyone heard of anyone on 9th or 10th yr of H1 ?
 
Any one got Notice of Case Closure letter from BEC, although your lawyer responded timely.
My lawyer and employer got a letter stating above. My case details. My lawyer responded to this letter stating that response to 45 days
letter was Fex Ex on 01/07/2005 with documentation.

45 days Letter responded 01/07/2005 (via Fed Ex)
45 days Letter received 12/28/2004
LC transfered to Regional 09/03/2004 (Philadelphia)
PD 04/29/2003 (state VA, RIR, EB3)

Buyouts are not that uncommon in the US. My company was also bought by another company. My lawyer advised me that as long as new comapny ( Y ) is ready to continue with your labor cert. process, it is fine. When DOL gets back for decision, lawer needs to submit the paperwork stating the buyout and new company's consent to carry on the process. My PD is Dec 20001 from Indiana SWA and still waiting for 45 day letter.

Problem arises when company (x) enters in a joint venture with company ( y ). I was told that may not continue the same labor.

My company acquired by another ..

My Company is acquired recently by another company. I am still working in the same job, location. Alos company name is not changing. Does it affect in any way my RIR in Dallas BEC. I'll appreciate help in this regard. Thanks.

This is my first post and I know for sure that Dallas BEC has started processing because I know somebody who is a 245i RIR case with PD 25 April 2001 and the lawyer received NOF in late January.
So please don't be so cruel or judge Icarus when you don't have any real facts!
I know that all of you are frustrated but don't be so impulsive!

Any tracking for the California State Labor applications. ?

Mine california state labor has PD 03/24/2004. Have not received 45-days letter yet. anybody has any info what's goin on?

In this kinda public forum, we have to ignore some posts & PEOPLE TRYING TO SHOOT THE MESSANGERS !.. Most of the folks here really appreciate what ICARUS, AKELA, THOMSHU or ORISSA brings to table. If some people don't believe in it, just ignore their posts.

Also, If someone on this forum have better info then this people (ICARUS, AKELA etc) Or solid reason to believe their info is wrong, then Post it .. Don't just shoot in Vaccum.

On a side not, My lawyer also has received 2 NOFs from BEC & has replied them. Once get some answers I WILL POST IT.
 
1-ICARUS says that DB should be finished by march 2006 whereas DOl says by end of summer 05. i think Icarus statement makes more sense bcs simply, Dol started entering DB in sep 04, so 7 months till now and they just entered 87,000 applications, this means that on avg it takes 6 months to enter around 100,000 applications, if there r more than 300,000 backlogged cases, therefore Db will take at least 1.5 yrs from sep 04 so march 06 is a good estimate and not late summer 05

2- about processing, Icarus says there will be 2 different independent lines, one for RIR and one for regular. DOl says it is a national queue.

3- Icarus says they started processing , Dol says they will start in late summer 05, here i think icarus may be right but to a certain extent.i think probably they started processing but i think it will be a long time till they reach full efficiency therefore i doubt that they will process now more than a few thousands if not less before summer. therefore i don't expect heavy processing before end of summer if not march 06 till they finish entering the data.

those are my conclusions. any comment?
 
The 45 days letter was received on December the 28th. The NOF was received at the end of January 2005.

Atleast they can post which priority dates are currently being processed just like before ... nothing less nothing more ..... that should reduce some frustu among ppl.
