Congrats and good luck with next stages.140 you can file it now and 485 you may not since visa numbers are not available for Eb3 category.

What is your Dot code/Job title on LC?

Is there a way to find out if my labor has already been approved at the Dallas BEC? It looks like it takes a month or two to communicate the approval to the lawyers and the employer. The BEC requested recruitement results for the case and this was sent to them last week.

Gurus

Since I can't file I-140 & I-485 concurrently, what advantage do I have by filing I-140 now? If I-140 is approved, what does this mean for me? What can i do with this?

Question to the board - is the I-140 process "easier" than LC? We want to file EB2 (BS+5), however some of my experience was gained with current employer prior to filing LC so I don't know if this is a risky approach....

Thanks for sharing the info pcc. I am not sure what you mean my "comprehensive" results for recruiting efforts. I guess it all depends on the lawyer and how he puts in the application.

My lawyer tells me that once the I140 is approved, one can change jobs and apply for a brand new labor application and still keep the priority date. Please note that this is not the same as AC21 where your I485 process can be continued after pending for 180 days with an existing I140 approval.

Again, I am not sure if this is correct information but this is what I found out from my lawyer.

I would just say that it just gets one more thing out of your way and you have nothing to lose. Just I-485 later may be faster with I-140 already done. Also, if any questions come up during I-140, you would have sufficient time to clear it.

New AC21 memo is expected. Rules may change. You may get portability with approved 140? Anything may happen. Just file your 140 and keep moving.

RD = Received Date (Received Regional Office or DOL Receipt Date).

This is correct information

Provided you have a copy of the old 140 approval from any EB category, you can claim that old priority date with a new labor application...clause 245(i)

I am going to claim July 2001 priority date hope dates will not go back beyond that date.

Eb3 Perm

GP & Guru's:

Even though RIR Analysis queue crossed 11/02, no news on my application :(.
My attroney is saying i can file an EB3 application thru PERM as a backup.
Is there any advantage in getting a EB3 labor with PD 08/05 or 09/05?
You cannot file for 485 for atleast 2 years with that PD.

Attorney is saying it's just for backup since i will be completing 6 years of H1.

When i asked why he cannot go for EB2 under PERM, he was saying it's very difficult to get a EB2 approval.
EB3 is easy and they got 3 approvals in last month.
He is not even interested to transfer my old PD (11/02) and go for PERM with that, since it's risky.

Any thoughts ??

Well, backup is misnomer IMO. DOL has indicated that filing a new PERM will automatically result in withdrawl of old application. You may be closer than you think. Remember that LC is just ONE step in GC.. more important (believe it or not) is actually be able to apply for I-485 - EAD/AC21/ and Actual GC is based on being able to apply for I-485.

Hi

Can someone give me the email address of Dallas BEC thru which I can get status check of my Case.

My Michigan (RIR) priority date is Dec 17 , 2002, DOL PD Jan 13,2004

I have received the 45 day letter in Feb'05 and the attorney has replied
on 3/25/05.
Any help /info would be appreciated.

I have requested Dallas BEC for the proof to file 7th year extn.They have sent me a screen shot with all my details it it and in that I noticed there is field for case status and it says CERTIFIED..Can I assume My case is certified?
