Question to the board - is the I-140 process "easier" than LC? We want to file EB2 (BS+5), however some of my experience was gained with current employer prior to filing LC so I don't know if this is a risky approach....

I would just say that it just gets one more thing out of your way and you have nothing to lose. Just I-485 later may be faster with I-140 already done. Also, if any questions come up during I-140, you would have sufficient time to clear it.gbroder said:Gurus

New AC21 memo is expected. Rules may change. You may get portability with approved 140? Anything may happen. Moved to Dallas back-log center before 1/1/2005. No 45-letter yet.
It's said all cases will be processed based on PD. Is that true? If yes, then which date should it be used to track my case?

You cannot file for 485 for atleast 2 years with that PD.
Attorney is saying it's just for backup since i will be completing 6 years of H1.
When i asked why he cannot go for EB2 under PERM, he was saying it's very difficult to get a EB2 approval.
EB3 is easy and they got 3 approvals in last month.
He is not even interested to transfer my old PD (11/02) and go for PERM with that, since it's risky.
Any thoughts ??
