Need some Info about name check

HI,
I mailed CSC reagrding corss-chargeability because of my wife's country of birth(UK). The reply I got is "The file will be requested from the file room and reviewed for possible cross chargeability to the country of U.K.
If all is in order, a decision should be made within 60 days".
Does this mean that my name-check has been cleared? or this is totally independent of name-check? My info is in signature.

I know your I-485 also has ND in early Sept like mine. Is your case tranferred to TSC also?

Any guess that they may speed up the process or the situation will get worse ?

My Case details

PD : Sept. 20th 2002
I-140 : RD : Sept 19th 2002, AD : March 24th '05
I-485 : RD : LUD : Oct. 5th '05

I looked at processing times and I-485 for EB2 for India is July1st '02. That means in about 2months, my case will become current when it is Sept. '02 and then I-485 processing in CSC is June 16th '05. So, can u pls. update me what's going on? Thanks for your help

I485 has been on june16th 2005 forever for CSC. Dont read too much into that date. Generally people whose pd ARE CURRENT are getting approved pretty fast .
In parallel, we are hearing that 15k pending 485 cases at CSC "are in the process" of being transferred to TSC/NSC (DONT KNOW WHICH ONE exactly)

Guys, has anyone seen any update on 485's online indicating transfer to another service center . Are there any guidelines on which 485s got transferred.

This may be bad news for people who are very near to getting approved :((
Atleast we had CSC guys respond to emails etc .Its refreshing to find some human, responding to questions.

If anyone has additional info on which 485s got transferred
please share it with the forum.

I don't understand what is your question.

Your PD mostly will be current in May this year, so you will get approval sometime in May / June if everything else (Name Check, FP check etc) is complete by then.

I have not heard anything about my case being transferred as of today. My guess ( again just a guess) is CSC might not transfer cases which are almost complete.

This move (transferring of cases & load sharing) will surely speed up the process in long run.
 
Gurus (GP) Please Help.

Can I accept a promotion while my I-485 is pending? I'm working in a fortune 500 company and I'm being offered a promotion. My concern is that the job description (which involves in management and marketing) is not even close to the Labor app. So, does accepting the promotion (within the same company) pose any problems with I-485?

As long as your company is ready to answer any RFE (which is highly unlikely) you are fine. If I ware you I would take promotion.
 
Hi GP,

Can you please let me know the approx time they take to reply whether the name check is done or not? I sent an email last week. Aslo what would be the ratio of cases which get stuck at name check level? My FP was done in Oct 05. As always I really appreciate your time and patience. Mine is getting current on 1st of april.

Reply of email from CSC : 1 day to 3 weeks

100% cases go to name check & as we have seen on this board around 1 out of 4 cases takes long time for that. It depends on where are you from, how common your name is & if there is any slight match of any combination of your name with FBI database.

You should also send email on April 01 & request to approve the case.

question on leaving employer

Hi all, please help.

I heard that if your I-140 approved and I-485 is pending for 6 months then you got I-485 approved, you can leave your employer. Is it correct?

Or you have to stay with them another 6 months from the date of your I-485 approval.

My question is as my PD is same as yours (Sept'02), right now Current PD is July1st 2002. So, in another two months, may be our PD will become current. After it becomes current, what is the next step? On my I-485, it says 10/5/2005, fingerprint review was received and processing has resumed on your case. I heard few cases transferred to TSC and I don't see on mine and My wife's cases for I-485.

Please let me know your feedback.

Yes, Its called AC-21. AC-21 allows you to change jobs in same/similar profession after 180 days of I-485 notice date

Or you have to stay with them another 6 months from the date of your I-485 approval.

Nothing required from our side. Once PD becomes current we should get approval, We can send them email on May 1st & request to approve to speed up a little bit.
 
FP notice time

Hi,

My I-140 and I-485 was filed on Jan 4. However, I haven't got the FP notice yet. My AP and EAD were approved.

Is this usual? How long does it normally take to receive the FP notice? I am afraid it might be lost in the mail. Is there a way to check if the FP notice is sent out?

That would amount to wrongful intent on your part when you applied for a GC & misrepresented the facts. Its acceptable that circumstances changed, but still you should stick around for a while.

On technical grounds, nothing's stopping you from doing it though....
