CSC I-485 Filing- May to Dec 2005 Tracking

FP Done !

Me and my wife have completed our Code 3 Biometrics procedure at San Jose, CA office on 3/17.

Question: USCIS link http://uscis.gov/graphics/formsfee/forms/index.htm says, "Fingerprints: Where instructed, you must pay a $70 biometric fee for electronically capturing fingerprints, in addition to the base filing fee."

When I appeared for Biometrics, I was not asked pay $70. Am I in same boat with others?

That is because you have paid $ 70 for FP when you filed I-485.

One more thing, just relax & wait for your approval when your turn comes.

One of my freinds got a approved labor with Sep 2001 PD and EB3. The company is applying 140 for him. If the 140 is approved can he keep the PD and apply for EB2 (from scratch).

YES. When he/she applies for the second I-140 (EB-2 one), attach the approval copy of EB-3 I-140 to retain original PD

name check vs background security check

for those who got a reply saying name check is pending, what are the exact words? Did it say "name check" or "background security check". Trying to figure out if they are same.

I-485 is still Jun-2005. I don't know what is going on with CSC. CSC's officers need someone to spank them to speed them up. I am MADDD.

based on an earlier email from gp and some other facts floating around in this forum the key date is your PD and not the 485 processing date! e.g. if your PD is current and your 485 filing date is July 2005, you will still get the approval. Of course it depends on how many guys have a PD earlier than yours!!
 
My ND is 09/08/2005 and my PD is current (Non-tro country). :-(.
I called CIS today to ask about my FP. She said that I have to call back after 60 days from the day I got response from them about my query email for FP. That says, If after 60 days I don't get FP notice, I can call back and they will schedule FP for me on the phone.

Not sure if she told me the true or she wanted me to hang up the phone :-(.

Any comment?

Response received to status query

Got reponse to query I sent to CSC for status check in first week of March, 2006:

Your application is under review at this time. You should receive a transaction notice within 45 days.
 
I specifically asked for name check and reply came back as background security check is pending result by FBI so not sure if it is same as name check.

I think we are splitting hair.

Security check is used interchangably with name check by USCIS.

Among the cases stuck, 99% are stuck with FBI for name/security check.

Dont worry about FP - its trivial. Maybe 1% cases are stuck here.

My impression on CSC's 485 processing is that their priority is solely on
how old your PD is, whether you're from retro-ed country or not.

I'm also from non-retro-ed country and not supposed to be affected
by whole retro thing. But I guess not. Our cases will take similar time
as some of cases from retro countries, I'm afraid.

I think it's fair in general since they're concentrating on oldest cases.
I just have learned that when retrogression happens, everybody
suffers, not just cases from retro-ed country.

I agree that they are used interchangeably.

But I noticed my lawyer started to refer it as "background security check"
after FP is done. Before FP, she refered it as "name check".

I never asked why but I assumed that security checks
somewhat inclusive of the name check, strictly speaking.
But technically the "name check" is the usual bottle neck
and thus effectively usable interchangeably....

I dont think this is true - there was a case from a non-retro country posted some time back which got cleared as soon as his 140 did.

Hi,

I got the following reply from M.Bueno one day after sending the email.

The FBI name check has cleared. However, there is NO visas available for citizens of India with priority date of 05/10/02 and classification of EB-2. Visas are only available up to priority date 01/01/02. Keep in eye on the visa bulletin board.

Background checks cleared

I got the following reply from M. Beuno

"The back ground checks have cleared. When visas become available, your
case will be Processed"

Now I dont know if this means name checks are cleared or not. I specifically asked him for FBI name checks.

Of course, there always are exceptions with or without retro.
But it clearly slowed everything since retro kicked in.

I definitely don't want it to happen but I think this is very
negative time for relatively newer cases from both retro-ed
and non-retro-ed counties, I'm afraid. Even worse (and scarier)
scenario is: By the time USCIS clear old cases and advance
priority dates current enough, LC backlog center starts to
pump out more old cases.

Then the cases filed within last 1 year or so might get stuck
more, taking as long as some of very old cases. The more
worry-some fact is that the LC backlog center pledged that
they will clear most of their cases by the end of 2006 AFAIK.

The small window of chances for us new cases is this summer
therefore (before LC backlog center increases output to meet
their pledge), IMHO. Well it's all speculation game but not much
concerete info/facts we get from USCIS or FBI anyway....
