Myself & my family(wife & son) got our green card in Jul’08. My wife and son have travelled to India on Sep’08. I have couple of questions to understand and manage my situation. Please help me here.
1) Is there any option they can stay more than 180 days out side of USA without jeopardy their GC? Since I do not have job I can not bring them here until I get job.
2) If reentry permit is the option can they apply while they are in India
3) Since Sep’08 I do not have job, is there any problem in retaining my GC?

Thanks in advance

--------------------------they should not stay more than 1 year out of US from the date they departed US. best option is to not spend more than 6 months if they want to apply US Citizenship.

-------------------------Re entry Permit can be applied in US.
3) Since Sep’08 I do not have job, is there any problem in retaining my GC?
-no
Thanks in advance

Thank you Ginnu. i really appreciate your response.

Right now we are not intend to apply for US Citizenship. Which means my understanding is they can stay upto 1 yr outside of USA.

My family is in India now, so can i apply re entry permit behalf of them here in US

No, each of them needs to be in the US when it is filed, and again for the fingerprinting. If USCIS figures out they were outside the US at the time of applying for it, they will deny the reentry permit.

One caution - Permanent Residents are only exempt from the statutory grounds of inadmissibilty (health, public charge) when returning to the US after an absence of six months or less. The odds are low, but if they are returning after >6 months and you are unemployed, they could be denied entrance on the grounds of being likely to become a public charge.

Get a job, and provide for your family. Bring them back to be with you.
