Could this pose a problem : Please Help!!!!

When I entered for the lottery I was in Grade 12, and on question 12 (highest level of education as of today) I chose: High School, No Degree.

Now my first doubt is whether I needed to have a High School Diploma to enter the lottery. Might I be disqualified because I did not meet the educational requirements when I entered the lottery?

Now I have a High School Diploma and I won it during my final exams. By the time I sent out my forms to KCC I had finished my exams and was more than sure that I would sail through.

But I did something foolish in filling out the DSP – 122. On question 6, about my highest level of education completed, I ticked High School Diploma. Technically I did not have a High School Diploma at that time (only received it in August).

In retrospect, I should have chosen High School, No Degree. Will this be too much of a problem and if it will, should I send out a new DSP-122 to KCC correcting my mistake.

(And I know this sounds silly, but I want to take no chances.)
 
if you had your high school degree by the time you sent DSP-122 and DS-230 to KCC, you'd be fine. You should have waited.

Eligibility is determined at the time the visa application/AOS petition is submitted. Remember, you don't have to be eligible to participate in the lottery or even be selected. You do however, need to be eligible to apply for and be granted an immigrant visa or adjustment of status. So, like Lucy said as long as you have your high school degree by the time you send your DSP-122 and DS-230 to KCC - you'll be fine.
 
I did not have a degree by the time i applied. Ok, that was a serious mistake.....but is there anything i can do about it? Will i be disqualified for sure??

I will today call the DV section of the U.S Embassy here and let's see what they say.

Called the Embassy, they said that it should be fine as long as i can present a high school degree during the interview.

But i suspect the knowledge of these people (i mean the folks who answer the phone -- they're not consular officers after all)

Can someone with real knowledge clarify?

It will come down to the day of the interview. As long as you can show your eligible for the VISA on the day of your interview they are not going to nit pick when you got things. The lead time for the DV can be up to 18 months from when the first NL’s go out and things will change for some people over that time.
Obviously I cant say that with a 100% guarantee, but the consulates operate on a system where they want to give you the visa, as long as you are eligible. They don’t try to find any hole they can in your application to deny it to you, they are at least in the American embassy in Dublin, very nice and helpful.

Obviously if you don’t meet any of the main criteria:

High school dip
Police records
Medical
Country of birth
Financial / job offer / sponsor

On the day of your interview then you will have problems.

The same happend to me when I did my electronic registration. I said I had my degree, but I hadn't. I thought I would get my degree before august, but things changed and i won't get until december.

When I replied the second letter to the KCC i ticked "Others" and wrote "College, no degree. Degree will be delivered by the end of 2008". KCC accepted my form.

As they said, they check your documents the interview day. Unless you have done a GREAT mistake (birthday, name or tell them a lie). you will be fine. But the day of the interview you will need your official high school diploma.

You need to recall your current form DS-230 and submit a new one instead, dated after you obtained your high school diploma.
You might recall your DS-230 by calling KCC or the consulate. You might even to write a recall letter to them.

The requirement is your DS-230 should be submitted only when you have your educational requirement fulfilled.

I will of course have my degree during the interview( but that is if i do get a chance....that's a different story though.)

Visa application is DS-230 form. You do the visa application on the date you submit DS-230. So, the requirement has to be met on the date you submit DS-230.

Thank you for your email. The winner MUST have the equivalent of twelve years of education at a minimum at the time of the DV interview.

I interpret it as an incompetent advice. However, you could send them the reference to 9 FAM and ask them if they still consider the date of interview as the D date.

Even if they do, you have no idea who exactly answers your email and whether that is a consul or not. And if you have another consul at the interview, his approach might be closer to 9 FAM quote.
 
They could also tell you that at the interview date they could retroactively reconsider the date of visa application as of the date of interview versus the date you have submitted DS-230. But that would look really strange.
 
The interview day is when you start existing for them. Their answer is crystal: must have at THE DAY OF THE INTEVIEW. Then, it doesn't matter if you hadn't the right documents when you did the registration. They just have to be valid, al least, the day before you do the interview.

But in a way it's like that. At the embassy here, every consular officer does their own thing...it's like the decisions are based on their moods......especially the student visa decisions.
 
When there are very strict guidelines, the decision based on the mood could be done only because of incompetence.
In case the guidelines are vague, it could be a different story. But here they are pretty much clear and very strict.

I would beg to differ with you ronnin, they've known you long before the interview.
Although I don't believe that darkhorse's issue is a big deal or worth concern on his part, I think it's important to avoid making misrepresentations of facts on anything you submit to the gov because it can be used against you in the future.
