Continuous Residence Question

Dear All,

I know this is a common question so many asked and so many responded. I need your advice on my wifes residence situation.

We have the interview on 4/21/2010 and my wife stayed in INDIA one time for 6months and 1 week.
During that time I was here working and I have all the tax docs and pay stubs. We own a house from last 5 years and I can show the proof.

Wife is a home maker and she stayed in INDIA for 6 months and 1 week because her brother got married during the last week of her trip.

What should she tell the IO during the interview?

Keep proof like wedding invitation copy handy to show IO. Check the dates match with her passport entries!!!!!! .Then there shouldn't be any problem.
 
I think your risk is very low, but it also depends on when the trip was. If the trip just ended, the IO can suspect whether she is just back to manage the N400. If the trip was old, maybe they won't even bother.

Also as Gunga said - is this the only trip, or is it a pattern of trips, even if some of them were slightly shorter than 6 months?

She did declare the trip on application, correct?
She should be prepared to bring evidence to interview that she maintained her primary residence in US while she wen to India for the long trip just in case the IO requests proof.

She took 4 trips to india in the last 5 years and only one was more than 6 months. Othere 3 trips were 3 months,4months and 2 months.

The trip that was more than 6 months is in 2008 (Feb - Aug).

So a grand total of 15 months absence. Again, we do not know if any of them were back to back, but anyway, this is enough absence for you to collate all residency information. Biggest benefit is you maintaining a residence (and I think living) in US while she was visiting. This should work in her favor.

I spent about 7.5 months in INDIA during the last 5 years and I made 5 trips total and no trip is more than 2 months. I am planning asking my wife to show my passport copy and N400 application to IO.

DO you think her 15 months stay in india during the last 60 months might look bad during the interview?
 
It is well within the limits. In fact, it is only half of what the rules allow, so I would not be too worried. It depends on the IO, but if asked - just need to handle questions right and provide documentation.
 
Hello All,

We compeleted our interview yesteday and everything went well. My wife told the IO that she was sick at the end of 5 months and could not travel. IO was OK with her answer and her file is sent for the final approval.
