This msg looks like your lawyer already responded to the RFE. Any ideas what the RFE was about ?

I think this is again a standard message. I remember seeing a similar msg on H1 RFE as well when you send the evidence to them. Basically they are just indicating that the process will continue from where it stopped at the RFE awaiting your response and now the time will be shorter than what the normal time is from the begining.

Thanks Navneet. Nope, not yet...no idea what it was for, but since she responded to the RFE without informing me or requesting any documents from me, I presume that the RFE was for some document(s) that she already had on file and had not sent across when the case was filed. My best guess is that it was the untranslated birth certificate for my wife. I think they sent a translated copy (Japanese to English) but I am not sure if they had included the original untranslated version.

- Whats your RD and ND for 485 only?
I think mine,Radd's and over's and all within a week or each others filing Dates...

:) Amen. I sure hope so. My case LUD hasn't changed since 06/09. Say, my wife's application gets approved in two weeks...what happens to my application? Does that get approved too?

Ihad the same message after my lawyer responded to the RFE and USCIS receieved it.. Normally it takes atleast 7 working days for hte RFE to reach the lawyer and by the time lawyer responds and sends it by overnite to USCIS it takes anohter 3 -4 days.... So I am not sure whts happening in your case.....Lets hope for the best......

yep..been busy with the newborn and travel..
no LUD's in my case...yet..

did u not check with the lawyer what this is all abt..
Did u all notice...VSC removed the 485 updated from their biweekly updates!!!
 
Another LUD on 485s, and RFE Details

Had another LUD today(checkout my Signature).

Attorney reported that she received the RFE today.
They have asked for docs regarding my legal status between Oct'04 to Oct'05.

As proof they have asked for I797, or school certs(not applicable in my case), or I94 [zerox copies for all]

She says she will be working on this and then get back to me, if any thing is req., actually she has all my docs.

I know exactly what you mean...baby just turned 3 months old last week...time flies.
I'm not privvy to contacting the attorneys directly (except for when I pay them), so I've been reliant on the employers, who haven't really been too proactive either. Their feeling now is that since the attorneys did not contact them either, it must have been something really trivial that they resolved very quickly. My perspective is that it is my 485 application and I've reimbursed the attorneys pretty well so I should be in the know..but whatever.

Wow, they're going wild on LUDs. Good that you know what the RFE was about.

Not only knowing but I have the required I797s[Approval notices] and their attached I-94s also proving my legal status in US.

I was originally on L1 then due to de-merger of my co they filed for H1 for me.
Now there is a overlap of L1 and H1 in my case. This might have confused them.

Nice to have a problem with an existing solution. Hope there is no other problem enamating from this.

Hope nobody else get an RFE. Worst is seeing an RFE msg and then waiting for a week on it speculating really increases one's BP.

It is such a great feeling to have all of you in this forum, share thoughts and tentions.

Could anybody tell me how long it takes to get the actual notice. The RFE was issued on Aug 7. Is there a way to get the RFE details before getting the actual notice by calling the USCIS?

Most of you guys are already through the I140 stage but due to the snail pace of Nebraska I am still stuck at 140. Any help would be really appreciated.

My wife's H1 RFE took about a week to get to the attorney. We tried calling USCIS and spoke to someone but were told that the contents of the RFE would only be disclosed to the attorney or the company. Not sure if the same applies to the 485 considering its individual context.

5-6 Business days.

Mine issued on 31st reached on 7th Aug.

No it is not possible to get the contents before it reaches the attorney.

RFE, Can you guys help?

I received an RFE email from CIS, haven't got the actual notice yet so don't know what its all about. Sorry for panicking this early but I have serious doubts about my attorneys handling this case well, thats why want some good advice from you guys in advance.

My worries are:
1.) The labor required BS+5 or MS+3. I have worked full time only for 1.5 years after my MS and before joining the current employer. However I worked at my university and at another company part time total for about 4 years (I guess it will be equal to 2 yrs full time), so that gives me 3.5 yrs; But the part time exp was before I completed my Masters. Do you think that would be a problem ? Does the exp have to be after completing masters?
(FYI, The labor was filed under PERM for me as a beneficiary, got approved in Feb 06.)

2.) Also, I was unemployed for two months back in 2001, but I was on proper H1 status and my H1 got transferred easily to the new company without any RFEs at that time, could that cause any issues?

3.) The exp letter provided by one of my previous employers (a very big company in the US) didn't list my job duties. Their HR said they didn't provide job details on the exp letter, thats their usual practice. So, my attorneys suggested that I would get a letter from one of my former colleagues/mentors from that company. I got that letter from my previous colleague on plain paper and submitted it along with the company letter. Do you see any problems there ?

I would really appreciate any help from you guys.

As per my knowledge its progressive experience which means MS+3 years = Masters Degre followed by 3 years exp after masters and same goes with Bachelors..ie BS= Bachelors degree followed by 5 years exp........ So if you dont have that then definately you dont qulaify for EB2...So if they send an RFE possibly they might ask if you wish to downgrade to EB3.....

Isnt it true that if the job requirement was for a Masters's, the applicant would qualify for an EB2 irrespective of experience? (If, of course, the applicant has the required degree)
