Glad to help....on a sidenote, you can do the Infopass and letter sending independent of your attorneys. Some attorneys might suggest that you just wait, but the fact of the matter is, being passive really doesn't get you anywhere.

Our 485 RD are Nov 06 and the 'Now Processing' dates are Dec 06. How can one open a SR? I heard one can only open an SR in TSC and not in NSC (where our files are languishing)...any idea?

You're definitely eligible to open a SR. You'd call the 800 National Customer Service Center to do so, and they would redirect the request to the appropriate service center, wherever your files are pending. You do have the option of calling the Service Center directly via PoJ and requesting to initiate a SR, but odds are 90-10 that the IO at the service center would ask you to hang up and call the national customer service center for SRs.

On another note, how are things with mailing the FBI about NC status and FOPIA request. I heard a few months back that FBI no longer respond to emails :-( Well since everyone and their mother is stuck with the NC process, I do not see anything moving forward.
 
No worries, I'd expect your AP to be approved within the next couple of weeks. When we got our first APs and EADs, both were approved on the same day for self and spouse; but the renewals were a few days apart. This was at VSC, but it seems like there is no pattern to having both be approved on the same day.

Actually both of us received our AP2 approvals today in the mail. However for some reason, my status online still says pending. Anyways this is a welcome relief since we can now finalize our vacation plans for December. ..Only if the 485 approval was this easy :rolleyes:

The FBI stopped responding to email NC queries way back in 2005 or early 2006 due to them being overwhelmed with the number of emails they got. There really is no way to ask the FBI directly about the NC as an applicant. You need to go through USCIS or a liaison such as your congressperson or senator.
The FOIPA is pretty simple, you just go to their site, download the form, and mail it in. However, the FOIPA does not indicate NC status one way or another, since NC encompasses several more record databases than does the FOIPA...the latter only checks to see if there's a record with your name in the main database....and odds are very very high, that there wouldn't be. Most folks go the FOIPA route first just to make sure all their i's are dotted and t's are crossed...it gives you a little more documenation when you approach the senators or congresspersons.

Nice! Congratulations....yes, if only the AOS approval was this easy...but that would mean CIS won't generate any revenue off of renewals :)

Received our notice from INS yesterday for 485/EAD/AP filing. Received Date August 2, Notice Date September 27, 2007.

The long, treacherous journey is officially under way.

Something a little scary has happened. About a month ago, my father in law was taken rather seriously ill and my wife needed to go see him as soon as possible. Anyway, we had just applied for our AP renewals and had to wait until they arrived. We put in an expedite request for her on medical grounds supporting it with letters from her father's doctors. Anyway, her AP was finally approved on the 25th of Sep and the document was mailed out on the 26th. Her tickets were done for the 5th of Oct and she left on that day. However, the documents did not arrive till the 5th evening and she left without them; the plan was I could mail them to her when they arrived. Anyway, they're still not here and she's due back at work on the 22nd. The USCIS notice says wait 30 days if you dont receive it before calling. We have no idea what to do - her job could possibly be in jeopardy. Anyone have any ideas? I'm going to call USCIS tomorrow and see what they say - I dont reckon it will be much since their email says wait 30 days before calling.

What about the first EAD and AP. I am not sure if the CCTracker has the correct dates but it seems your first AP was approved on 01/19/07 so that means it should be valid till Jan '08, so if that is accurate she might be able to enter using the previous AP. The renewal AP will have a validity date starting a day after the expiry of the first AP, i.e. it could be post dated like in my case (AP1: Jan 07 - Jan 08, AP2 : Jan 08 - Jan 09).

I am not sure what other options could be used, perhaps enter on a valid H4 and then resume work on EAD, however thats just a guess.

The situation at my work place is extremely pathetic.

My immig. situation is that I am currently on an H1-B trought my employer but I have an EAD and AP trough my wife's GC process.

The (worst case scenario) question is:
If I quit my current job can I be legal in the US only on the basis of my EAD and AP i.e. I will not have an H1 or H4 status but only my EAD and AP.
Is it enought to only have EAD and AP in my current status or do I need to switch to H4.

Please advice .... urgent.
 
My understanding is that you do not need to change to H4; You can start working on your EAD and travel using your AP; Please make sure that you renew your EAD/APs regularly before the expiry of your preceding ones. You would need to keep renewing them until your GC is approved.

You're all set. You are 100% grade A legal.
You're official legal status is 'Applicant for Adjustment of Status to Permanent Resident'...or 'AOS Applicant'. As long as your EADs and your APs are valid, you can work and travel absolutely legally. Heck, you're in a better position for the EAD than your spouse since you'd be the derivative and can flip burgers based on your EAD if you choose to, whereas she'd be bound to working in the same or similar capacity as her labor.
SO relax...its employment at will...if your situation is causing you grief, its best to extricate yourself from it.

vik, Sorry about the upheavals...hope your father in law is doing well.
Now, I'd suggest calling the service center via PoJ directly and explaining the situation. However, if she's traveling on an AP thats currently valid, isn't all of your concern moot? She has an AP currently so she's good to go. She's an adjustment applicant, with a valid AP, they cannot give her any hassles whatsoever.

I am at a critical decision making stage and wanted to make sure that I have covered all (immig) aspects before I resign.
I do not want these jerks to take any more advantage of my situation.
 
Follow up question

KS, Wellwisher any one who can throw some light.

The derivative of pending AOS with a valid EAD/AP if they do not convert to H4 should they be employed at all times or could they be in legal immig. status while not employed?
