Concurrent Filing I140 & I485 Nebraska Service Center

Concurrent Filing
Grapewine has it that concurrent filing of I-485 with I-140 pending uptill 07/30/2002 will be accepted. Any application of I-485 under concurrent filing rule will not be accepted by INS with pending I-140 applied on or after 07/31/2002.
I am not sure how authentic this news is. I just thought of sharing this with members of the forum and invite their views on this.

I have very clearly stated that I am not sure of authenticity of the information. One way of clarifying this news is to post it on this forum so that informed members will contribute their views and experiances thereby get to the fact.
This is precisely the reason that I have posted this bit of information on this forum.
One way of looking at the information is that since the rule has come into existance on the 07/31/2002, all the people whose I-140 is pending as of that date given an opportunity to apply for I-485 with I-140 RN and it will be treated as concurrent filing. But all those who are applying after the said date can anyway apply concurrently (i.e. I-140 + I-485). If someone applies only I-140 after the said date then it might be assumed that the person doing so has done it conciously for his/her own reasons and in such an event if he changes his mind later and applied for I-485 with I-140 RN, INS might be of the view that this may not be allowed since person doing so had the opportunity to apply both at a time.
This is my two cents worth. I still claim that I may be wrong. The subject is still open for discussion.

when i filed my i140 & 1485 my lawyer also told me the same thing as you have mentioned above. People who have to take advantage of the concurrent filing after 7/31/2002 should apply for I140 & I485 at the same time. If you chose to apply for I140 only then you have to wait for the I140 approval inorder to file for I485. Hope this helps.

I read the oringinal Interim Rule that was published in the Federal Register, Vol. 167, No. 147, p. 49561. It clearly mentioned that you may file I-485 with the receipt of I-140, which was dated either on or brfore July 31, 2002, or after July 31, 2002. That's why I filed I-485 when my I-140 is pending. In my I-140 case (EB1), I need to wait for 6-8 months for it to be processed. Since other catergory such EB3 is approved in a month or so, in my view, there is no need to file I-485 concurrently if you have already filed I-140.

I have just received FP notice scheduled for 11/20/02. I-485 RD 09/27/02 ND 10/17/02. EB3/RIR. NSC.
I have a question. Can I go for FP in any of the application service centres of INS in the country. Because I may not be in my home town entire November.

HI everyone, I am a silent observer of this thread,I really appreciate all the work u guy's are doing especially people like WXM8,Sachdev,Sahin for all their work on this thread,
I just wanted to let u know that my I140 has been approved as of 10/28/02. some how I was very lucky so far my labor has approved in less then 4 months, and I140 in 29 working days( considering 5 days / week).
I was really frustated as I have not received my I140 receipt while I got my other I485,I765 & I131 receipts.
fortunately my attorney had received my receipt yesterday evening and she gave me my LIn number for I140 today,
I checked my LIN on INS online Case check and found message saying The case has been receive on 10/03/02 blah,blah...
but I called the INS today in the morning I was able to talk to Immigration officer she told me my case been approved 10/28/2002 and notice has been sent to my attorney.
