My lawyer send out query on Feb 18th. I am waiting for response. I will keep you posted as soon something comes up. Looks like they have some problem with Sub. Labor. It has already crossed 90 days since they have received reply for RFE. Lets hope for the best.

I-140 Denied - EB3 - Original Labor

Hi All,

My 140 is denied. Here are the details

RD NOV27th (concurrent filing)
RFE Issued on Company Financials - Jan 27th
RFE Received by INS on 21st FEB
Denied on April 1st.

1. Website doesn't show the denied status
2. AVM says the same as website
3. I never got a Denial notice from INS for I - 140.
4. Today I recieved a 485 Denial notice which states that
"485 Denied cos' your 140 is Denied" and that is how I got to know that my I 140 is denied

5. The notice states "Your 485 filed by XXX recieved on Nov 18th " was denied. The funny part is Niether my name nor my Lawyer's name is "XXX" as stated in the message. I didn't even mail my application on Nov 18th. I mailed on Nov 25th so I don't know what's going on. But All the WAC #s(485, 131, 765) are mine on the denial notice. I am terribly confused.

Has anyone ever heard of this situation.....

It will be great if someone can throw some light and what tell me what I should be doing.

My iEAD is denied today @ SFO

My iEAD is denied today @ SFO

Waited for 5 hours (outside and inside the BCIS) and was told by the officer that "since my I140 is still pending, they cannot issue me an iEAD." Is this true? My H1B is going to expire 5-17-03, so I ask him can I still work legally? He said Yes! But how can I work legally without EAD or H1B? I am very confused and appreciate your opinions on this situation. Thanks!

You should get your EAD. I don’t know what happened with your case but if you waiting more than 90 for EAD and your I-140 still pending, and you did not get any RFE you should get your EAD.
I got mine and for my wife week ago. It's valid for 8 month.
If your H1B expire technically you can't work.

Can anybody explain the meaning of WAC xxxx?
for instance what is the difference between
WAC-02-xxxx and WAC-03-xxxx and etc. Thanks.

My I-140/485 was filed with CSC during April 03. I would like to know how long does it take to receive the receipt notice and secondly, will you get the original receipt notice from the attorney/company or just a copy of it?
