i think that is incorrect. u should ask lawyer to ask for clarification and explain to INS that ur PD should be the one from the original labor. lot of people have even got approved here using a sub labor after the retrogession.

Are you aware of concurrent filings using sub EB3 labor cert filed after Jan 1, 2005 and accepted ? All the posts I see on this thread appear to have filed before Dec 30, 2004. Not sure if the above CSC rejection was because of an error or a change in policy since retrogression.

Anybody else with info on this, your input is most welcome.
 
when did you get the rejection - how many days after filing?

When was it rejected? sorry didnt see other postings from you .. just joined this forum.

My application was filed recently - on march 24 2005 & got the receipts from USCIS ok..

EB3 substitution- PD: 9/4/2001
I 140/ I485 /EAD/AP : RD : 3/24/2005

This was for a case filed two weeks ago. Based on that, my company lawyers are unwilling to file my 140 and 485 concurrently using sub EB3 labor cert.

I heard from someone else on this forum that his was rejected as well and had to file separately. If yours was accepted, then it suggests a non-uniform policy.

Anybody else with info on this or in a similar situation ?

Murali3m, you filed with CSC ? just confirming though this thread is only for CSC filings.
 
I-140 Approved (email only)

Folks,

I got an email today from USCIS that my I-140 was approved. I have enclosed the timeline below for reference. Note that I did not have any LUD changes, except on approval. I am waiting for the actual approval documents.

07/2004 Pure concurrent filing of I-140 and I-485: end of July
08/2004 Receipt for I-140 and I-485 received: beg of August
09/2004 Received FP notification: beg of Sept
09/2004 Received AP and EAD approval notice: end of Sept.
03/2005 Received I-140 approval email on Mar 31st.
 
I140 Approved but USCIS Online System NOT updated

Hi Everyone,

My attorney told me that they have received approval of I140, but when I do online status at the USCIS website it is not updated.

Also the processing dates released by CIS shows that they are processing I140 and I485 from October 2004. My I140, I485 were filed on August 2004, but I don't see any update on I485.

Can someone help me answer these questions. Your help is greatly appreciated.

I'm in the same boat. My I140 approval was received by the lawyer but no updates on the online status. My I485 is pending too.
 
Did you file for Amended I140 ?

LUD with 140

Hi, everyone,
I filed my 140 and 485 eb1 03/19/05
the receipt date is 03/23/05
LUD for 140 and AP is 03/23/05

but today I got another LUD for both my 140 and AP
on 4/18/05.

Is this a good sign or bad sign. I am going to
do FP on 4/21/05

Not sure if this is the right place to post this message.

Anybody has a similar situation and has their AP approved recently? Read some old threads and found out that usually the AP is approved before EAD. But nothing happened since they received it in my case. :confused: Thanks.

My LUD changed yesterday due to fingerprinting. Should i get an email everytime LUD changes? I have not recieved any email.

I am happy to share the news that I just received approval email notices of our 485 applications. Both mine as well as my spouse's 485s were approved together today. I-140 was approved on 4/1/05.

Thanks to all (Rajiv Khanna, immigration portal, USCIS and most importantly thanks to my fellow applicants who help/support each other in this rather tiring journey of GC).

Good Luck to all waiting in line.

Original LC - EB2 (Self): Filed Sept 2002...still pending
Filed EB3: 140/485/EAD/AP using copy of subs labor - Jan 2004
PD on substituted labor: June 1999
(there was a 140 approved on the LC which was being substituted) - original beneficiary had left the company after 140 approval.
1st EAD/AP approved: 04/2004
FP: 04/2004
2nd EAD/AP: applied 02/2005...awaiting approval....
I-140 AD: 04/01/2005
I-140 LUDs: 01/10/05 - due to inquiry??, 03/31/2005 with no msg change, 04/01/2005 approval message
No RFEs.
I-485 AD: 04/29/05 for self and spouse

Which is relevant ND or RD?

I just received my receipts from my lawyer. The Received Date (RD) is 04/14/2005 and Notice Date (ND) is 04/19/2005.
Now my question is that the processing dates of California Service Center - does it reflect RD or ND?

Also I have seen many more acronyms. Can any one post the expansions for them.

140 approval notice & 485-Inquiry!

My 140 was approved on 05/05/05 and have not received the approval notice yet.
Meanwhile my lawyer sent an inquiry on my 485.
Below is the inquiry and the response.
Could some one tell me what it means?
