Concurrent filing 140/485 Tracker-CSC

Have u noticed, the CSC has updated I-140 and I-485 processing time estimates to 270-300 days and 660 days respectively. EAD / AP was the easy part...hmm...
 
No one can match my record

I filed my I-140 last year in the month of March.
It is now 575 days since my case was filed, my case is still pending.
In the meantime I got 2 RFEs and responded to both of them.
Last RFE was responded 4 months back. Neither my employer nor my attorney has any clue. Recently got approval for 7th year extension for H1B and sent it for stamping.
Initially the processing time was 60 days then 158 - 60 days, the 30 - 60 days. Now it is 270 to 300 days.
Is there any one out there whose case is pending for more than 500 days? Looks like my case is going to make a record.
Nowadays I don't have any expectation from BCIS. As long as I keep getting my H1 every year I am happy. Just wanted to share.

Any recent approvals in EB2 I-140 cases concurrently filed with I-485/EAD/AP.

The CSC processing date has been sitting there on 05/05/03 for a while. I am wondering what is the effect of prima facie review. Are there any approvals with RD date on or after 05/05/03 after the implementation of prima facie review.

My RD is 05/15/03. EAD & AP got approved but no word on I-140

Finally after correction in INS system what is waiting period for I140, is it (160 to 190) or (270 to 300)?

we need to be pessimistic while dealing with INS :D
Its 270 to 300, and to be more pessimistic it is 270 and 300 business days ( kidding).

concurrent filing EAD/AP

hi guys

my 140,485, ead, ap was RD on sep 23 '03. how many days is it taking for eap and ap? i heard they are approving ead and ap fast? is that true? how fast?

is 140 processing stopped or what?

I am wondering once I-140 is cleared/RFEd whether all the folks provide the details in this forum. They might forget this and jump onto I-485 forum.

I request all of the folks to update this forum based on the update they get on their I-140.

It helps us a lot.

It depends on whims & fancies of USCIS. However, 4 months should be a good guess if not earlier. USCIS is processing EAD & AP fast for concurrent filers.

Adjudication Priorities
The priority for adjudications until September 30, 2003 is that of religious worker cases. It is anticipated that in October 2003, the adjudication of adjustment applications (I-485s) will resume at a faster pace (perhaps double). It is also expected that in October the adjudication of Employment Authorization Applications (I-765) and Advance Parole Applications (I-131) filed concurrently with I-140/I-485s will be faster, so that eventually these applications will be adjudicated within 45 days.. By the end of September 2003, it is hoped that H-1B visa petitions, except for extensions, will be processed within 90 days. H-1B visa extensions should be adjudicated within 4.5 months and eventually by the end of this calendar year - 90 days. However, the processing time for Immigrant Visa Petitions (I-140) will be delayed.

If you don't get EAD approved within 90 calendar days and no RFE was issued on your I140, you may collect interim EAD from local USCIS office on 91st day of your RD.

I140 shows no forward movement for the last 2 months. JIT dates move backward only. So start developing patience.

i heard 90day thing about EAD. what about AP? does that apply for AP too? can I go get AP if I don't get anything until 90 days?

i also heard that if there is any RFE regarding 140, it should be within 3 or 6 months from ND. because after 6 months, if i leave my current company and join a different one (with same pos, job role etc), how do I respond to any 140 RFE at that point?

been patient for 3 yrs to get labor. .i wish it was 'perm labor'..

If you leave your company from which I140 was filed before I140 is approved, you have to start the GC process from LC again.

Here is the rule,

AC21 portability(joining a differebt company with same po, job role, etc) is applicable only if I140 has been approved and I1485 has been pending over 180 days. The advantage of concurrent filing is that 180 day clock start ticking when you have filed your I1485 which may be filed along with I140 or with receipt notice of I140.

If you receive RFE on I140, the 90 day count for interim EAD will start again from the day when RFE reply is received by USCIS.

There is no 90 day count for AP. However, you can approach USCIS local office for emergency AP if you can show enough reasons for the same.
 
It really depends, if company is willing to support, you can continue on your I-140 even without job for a while. AC21 only defines 180 days for I-485. For sure with I-140 approved it is safer. Some time people has no choice. One of my friend changed job with I-485 pending < 180 days and I-140 pending. Just some information for your reference, please check with your attorney.

I have filed my I-140 on 08/25/03 and I-485 on 10/03/03.
Will this be considered as concurrent filing?. Our attorney says that this was concurrent filing.
I also did not get any receipt for my I-485 so far. Who is going to get the receipt for my I-485?. Is it attorney or BCIS send it directly to me?
I heard that BCIS takes about two weeks to issue the receipt for I-485 petition. Is it true? If this is true why I did not get the receipt yet?.

Your attorney is correct. It is concurrent filing.
USCIS( formerly BCIS ( formerly INS)) sends receipts of I485 to attorney. Though it usually takes about 2 weeks, allow upto 4 weeks. USCIS is in such a mess that they are delaying eveything.

If I-485 filed before I-140 approved, no matter same day or some days later, it is concurrent file case.
