Complicated Situation - Filing I-130 From New Delhi, India

My wife(US Citizen) & I(Indian Citizen) were recently married. We've been in India for over a year now. We are planning on applying for my immigrant visa to USA(I-130).

The problem is my wife was married in USA before & she has divroced now with proper documentation of divorce.

It was a short marraige(I guess they were too young & just immature) & she had filed a visa petition on her Ex-husband's behlf in USA. She does not remember when/where they had filed it together but he still has not received his Green Card. So I'm guessing they divorced before he got his green card.

Now would this pose a problem for us since she is petitioning for me now, would the previous marraige+visa petition look badly for our petition?

Any help is greatly appreciated!

In order to sponsor you , your wife needs to furnish the previous marriage divorce papers and the decision with regards to her previous I-130 petition case decison. If she can provide these documentation , there should not be any issues.

My wife does not know the current status of her ex's application, only that he has not received a green card yet.

Is there anywhere she can contact to get the information from the forms they filed (they do not communicate anymore), are there public files?
