Claiming benefits after GC

Hi Gurus

Here is the story of my uncle(my wife's father). He was in USA for six years and worked in IT industry. He has filed for GC while he was here. He went to india (in August 2001) and stayed there for two years, meanwhile his I-140 was approved and went for CP, which was approved. He came here with his wife in October 2004.

My question is Can he apply for unemployment benefits?

To claim UB, one must be the one who recently
lost his job with an employer (maube himself
if self-employed) for certain amount of time
during which the employer paid for UB premium
 
He quit the job

He quit the job. He has to leave the country because his six year h1 visa term was over. This was in the year 2001.

do you think he could claim the benefits?

There is a "statute of limitation" for filing
for UB. For layoff in Year 2001, the statute i
of limits run out

if the quiting is due to the condtions beyong one's
control making one impossible to work, then
quiting itself won't disqualify quiter for UB.
If H1B expires and H1B worker has to quit,
I think that fit the situation. But unfortunately
if H1B expires, then he fail another
eligibility criteria - one must be eligible to work
to get UB benefits

I had a friend whose mother was legally his sister. At first I thought it was just because he was from southern Alabama, but it turns out his grandparents had legally adopted him. ;)
 
Need advice from Gurus...

My 485 was approved last september. Got laid off and went into another company and worked till last friday (02/25) as my contract ended. Can I apply for unemployment benefits? One of my friend told me not use the benefits as it might be a problem when getting the citizenship.

Please advice why we can/cannot use unemp benefits before getting citizenship.

Appreciate your time and help.

Your friend is wrong. Unemployment Insurance benefits do not meet the definition of "public charge".
