08/07/2004: PERM update

Probably, by now people are sick to hear the term "PERM." There have been few "promised lands" which have not been kept and frustrated people as bad as this one. Ever since the DOL released the so-called "Five-Year Strategic Plan" in 1999 announcing the backlog reduction strategies which included the backlog reduction for existing cases and start of the PERM program for the new cases, it has surfed unknown territorial water over and over with no end in sight. After a struggle, DOL was successful in releasing the "proposed" regulation. Reportedly, the proposed regulation produced mountains of comments of pros and cons, giving the DOL an excuse for the further delays. Along the way, there was a change of leadership in the Foreign Labor Certification Division in the DOL leading to another delays. For heaven sake, despite the hurdles after hurdles, the DOL was able to work out the final regulation under the new leadership and forwarded it to the OMB in the White House in February 2004. When the 90-day review ended on May 21, 2004, the DOL reportedly requested the OMB to extend the OMB review because of the comments from its sister and brother agencies of Homeland Security Department, State Department, Department of Justice, etc. In the June AILA National Conference in Philadelphia, the Chief of the Foreign Labor Certification of DOL who was in charge of the PERM disclosed that the final regulation had to be revised because of the "room for fraud" concerns addressed by its sisters and brothers. The question remains where these brothers and sisters were when the proposed regulation was released!
Now this regulation is being held hostage in the White House. The American economy is continuously struggling despite the rosey picture some so-called "financial analysts" and political pundits attempt to draw through the cable TVs, Internets, and printed newspapers. Unemployment rate continues to remain high without much changes. Outsourcing has already given a trouble to the Bush Administration in the 2004 election politics. Now, we start hearing a rumor that the concept of "21-day" approval of foreign labor certification rather than taking years and years is the last "word" which the White House wants to hear under the current election environment. Anti immigration forces have also been working hard to picture the PERM program as "opening a flood gate for the foreign cheap laborers." The truth of this rumor is still unverificable. One thing we can only tell is that the regulation is going nowhere in the OMB, White House. The 90-day extension will reach on August 20. God knows what will happen then. No wonder why people hate politics and the term "politician" is not a noble term, unlike "statesman." Come November, whoever wins, we want to see a life which is not "totally" washed out by politics.

Did she tell why? If it takes them 2-3 months to process cases filed between Dec 17 and Jan 02 it would take almost a year to clear the Feb 2004. Mine was sent to Chicago DOL from Iowa on Feb 6, 2004 and I'm not able to get any info from AVM.

Reason she gave was "its going slow....so you need to be patient"
She didnt utter anything more than that. :confused:
 
Does anyone have any idea wut are the current processing dates of chicago DOL. Is it still stuck at dec 17th, 2003 or did it move forward. Please let us know if anyone has idea.
 
Still Dec 17th...

I called the Chicago DOL this morning to ask about my case number and found out that they are still processing Dec 17th cases.

Sent to Iowa SESA in Dec 2003.

Any chances to file a I-140 this year?

Actually, what is a priority date? Is it the same as RD?
 
correction JAVAGUY...They are NOT processing even Dec17th cases.
They are stuck there and still working on temporary visa and other stuff.
Anyway PD is the priority Date ,that is the date on which your application went to SESA.

Why don't you be patient and wait for your turn,
there's no point in calling the Chicago operator everyday,
they are only receptionists and generally they hardly know anything more than we know.
If at all you want to have any info, you have to talk to the Super,
Ms. Gonzalez,
and try calling her.
Please don't blame me for negativism,
but there have been people waiting since 2001, though they are regular cases.
As I wrote in my earlier post, Chicago is not going to process any app in the nearest future, their priority is temp labor apps,
which have to be processed in timebound schedule,
so all our fretting is not going to help us.
In the case of RIR cases, assume 3 months for every one month of backlog and plan accordingly.
The regular guys like me, all we can do is wish them success and wait forever.
For posters asking again and again as to where they should call and what is priority date,
please read earlier posts before asking,
the forum is over 255 pages long and I am sure all the pertinent questions have been already asked and answered countless times.
Let's not make the forum boring, the fact of us waiting is boring enough.
God help us all.

if you are smart enough to advice people not to rely on newsgroups, it is expected of you to get as much info from earlier posts.
Please don't feel offended, this is a most wonderful community and people don't mind helping each other selflessly.
Let us make our lives a bit more interesting.

I called them to find out my case # and while I was at it I asked about processing dates. I think 3 months per one month are a very pessimistic scenario. :eek: They should be done with temp cases very soon and once they start working on RIR it shouldn't take more than 1 month per month. :rolleyes:

I would be the first one to wish our cases getting approved,
but I spoke to the Super a month ago,
call it a lucky break or whatever,
she categorically said that permanent labor apps are not at this time their priority.
You have to factor in the November elections and the Christmas holidays into the formula.
I wish I had not talked to the Super, but one cannot avoid one's fate I guess.
Its always better to have some cushion time so that if things go awry, we can have some other plans like Canadian immigration.
Having said all that, the waiting here is going to definitely reduce our I140 and 485 time since we have our priority dates locked in and even if the emp visas backlog we will be saved.
My bet is, as I wrote in my earlier post,
we all will get an amnesty along with the illegal guys after the elections are over.
Let us hope by then that the CIS would issue walkin green cards or at least cards in 3 months.
 
longestlabor is right...whats the point of calling avm everyday?? ur not going to find anything drastically different..and javaguy,you are lucky that your SESA took only 2 months..there are a lot of people here with SESA times of 2 years and plus..so u can only imagine the frustration now that chicago also got delayed..

Yes, but a DOL director explained to AILA (I read that somewhere - don't remember where) that they would resume processing permanent labors somewhere starting in August. So we should hope for the best.
 
one good news

After a long wait......... they have certified one case of received date dec17
ie case 054**961 on August10 2004 so we can imagine how slow they are,
keep patience they will reach us one day.

raghu0707 is correct... Case 054***961 certified on August10 2004. This could be a random pick or a trick to cool off CHICAGO RIR applicants by CHIC DOL.
May be CHIC DOL resumed processing RIR application paritally?
