Hello

I am employed in US and applying for I-140 & I-485 together in 'Outstanding' EB-1 category. My wife and kids are Canadian Citizens and currently in Canada. We would like to apply for I-485 together for the family. My family will visit US when we apply for I-485 but would ideally like to go back to Canada soon because my wife is employed in Canada.

Q1: Is there a minimum number of days my family has to stay in US after filing for I-485 ?

Q2: Does my family need to apply for Advance Parole ? Being Canadian Citizens, they were able to travel to US easily so far. Does applying I-485 change that ?

Thanks
Ajay

1- It is not working like that. For them to apply for I-485, they should be in US on certain status e.g. H, L .....etc. Not just entering to file I-485 being canadian (I may be wrong)
2- Any applicant from any where with pending I-485 should have valid AP or on few other status e.g. H, L .... to travel outside the US and keep his/her pending I-485 valid even if canadian
