Hello, I would like to know if I could work part time on a H-1b visa. The part time job is not involved with a contract or offer letter. Is it illegal to work there without a concurrent H-1b visa? Please let me know what you think.
Thanks

Part time H1

This is an extract from one of the H1 links. hope this helps

The length of time that a worker can have an H1B visa is usually an initial period of up to three years. The initial H1B visa can then be extended one time for up to a combined total of six years.
Other regulatory provisions permit;
(1) the employer to request a period of less than three years,
(2) the employee to be employed on a part-time basis
(3) the employee to work for more than one US Employer simultaneously

Whether you work part time or fulltime, your yearly pay (W2) must equal to your First H1 LCA amount or other minimum wages.

Part time may not fulfill this threshold unless you heavily compensated for part time job.

If you get less than LCA amount per year, your future H1 extention or immigration petition may be in risk.

P/T H-1 wages

hello great guru,

i had a question about part time H-1. You mentioned that whether one works F/T or P/T, one should be paid the amount mentioned in the first LCA.

Say one is getting US$50,000 annually for F/T job (40 hours per week).
If one switches to P/T (working say 20 hrs per week), he/she would be compensated with US$ 25,000 annually.

Minimum wage for the job is say US$42,000. Since, the compensation for part time is less than the minimum wage, would CIS not approve of the change from F/T to P/T?

Please elaborate.

Thanks

At least one job must pay the amount stated in the LCA. And even to work parttime, you must have a H1 for that job.
