can i leave usa with EAD ? please help

hi guys

i already had my interview last month , which was terrible ! they told me they will let me know in 90 days . anyway since that time i didnt hear nothing from uscis . even the case havnt been updated till now .

now i really have to go back home for few weeks , what do you advice shall i leave with my EAD , if so will i have trouble comeing back to US ?

any help appreciated

What is your current status ?
Unless you are on H1/L1 status, you definitely need Advance Parole to come back to the US. Sorry, but EAD won't provide any status so that EAD alone is not good enough to use to enter the US.

my current status I485 pending , based on marriage . if i get advance parole . will it be okay to come back to the US ? with no difficulities !

Posos,

You can apply for an AP, BUT DON'T LEAVE THE US, with the hope of coming back on an EAD.... :D POE officer will laugh at you on whether you are nuts or what.... :rolleyes:

I am not sure what is your immigration background, because for some people who have been here for like a billion years as illegals, :cool: I don't advise them to use an AP to leave and come back, but rather wait for their greencard to be issued or passport stamped with I-551 stamp... :eek: I advise no one to rely on AP when dealing with POE officers, who can mistreat you and send you back errorneosly... :mad:

If issued an AP, then you can leave and come back.... :)
 
if you have ever been out of status for more than 180 days, DO NOT leave the States, even with AP.

I have AP but 485 is pending on name-check. I have never been out of status. What do u say about the chance that POE might send me back when I get back?

You might be sent to secondary inspection which is not uncommon when AP is used to enter, but you should be fine.
