yeah I observed this too! What's up with this Employer TAX ID? Its not asking for case number or the Employer phone number anymore? Anyone knows where I can find this TAX ID?

silentreader, congratulations! If you don't mind could you share 1st 7 digits of case number like 095-335-XX.

Others, I tried checking status of some october 17 and 21st cases (DOT code: 999-151-031) and all are still in received status.
 
Questions

In the AVM it asks for a Case Number -
now is this the case number that you get thru EDD (6 digit) or is it the new case number assigned by DOL?

Also is there any other phone number to call for the Calif DOL?

DOL Assigns a case number when they receive the case which is different from the SESA Case No

Are there other friends whose RD at DOL is aroung 15th October 2002 with DOT code 999-151-031 and are still in received state :confused: . Please share your information.

Which number / options of DOL AVM allows you to enter TAX ID ? I tried just now & asking me to press 1 if I know Specific Case No & Press 2 to search by employer phone number.

Labor certification has nothing to do with EB2/3 (It's not even mentioned anywhere in the process !).. If your advertisement is taylormade for you, your company has not done any layoffs in last couple of years & DOL HAS STOPPED REMANDING RANDOMLY.. you have good chances of getting approved.

If ur company is a big one with layoffs, chances of approval are very slim.

If ur employer is a typical desi bodyshopper - a typical bodyshopper does not layoff employees, he just lets them find another employer and this does not count as a layoff - then your chances improve.

Again - the job adv needs to fit your profile and needs to be non-restrictive - then your chances are pretty good.

Remanded to state

I have been following this forum for almost an year now.

Just received an update from my lawyer that my application has been remanded to state.

I work for a very big IT co located in SFO with layoffs.

My lawyer said I received the 3 options letter and as the co policy is not to retest the market (given the job market) it is being remanded.

Also an info that my lawyer provide is DOL is working on a policy which is going to effect the cases which were AUTO REMANDED and this policy may not have any details regarding those cases which were remanded because of 3 options letter.

My DOL RD is 10/21/02.

Today my lawyer called and said that my Labor has been certified.
Details are:
RIR PD - Oct 2001.
Assessment Notice from State - Oct 2002
RD at DOL - 11/05/2002
Approved - 08/26/2003 (No NOF from DOL)

Case Number - Not Known
Job - Software Engg.
LC Job Description - MS + 1 year experience
Location - Bay Area
Company - Mid Size. Layoffs back in 2001......but actively recruiting.

So for those you would like to know.. RD early Oct 02.. still waiting on any response.. I have no idea about my case #.

Anyone know how it works with the tax id? I used my employer id from my w2, but it does not recognize it.. Not sure if the tax id is something else.. Also, its a public company, so will it be available somewhere else??
 
TAX ID and Remanded cases

Sorry guys my bad. I was selecting second option which is LCA. Rather I should have selected first option which is permanent application. futurisbright try the same.

I heard from my lawyer that DOL is still in a decision phase for the blindly remanded applications. She also asked the DOL about ETA and the DOL said it could be upto 6 months.

looks like big company + layoffs is a bad combo.

Hi All,

My case has been transferred to non-RIR queue.
Company is mid-size with a few layoffs
Job -description:Software Engineer
DOL receipt: End of Nov 2002.

Does anybody know how long it takes for labour
to clear in non-RIR queue?
