Hey guys looks like this is good news. Instead of considering current market condition for the RIR

denial it seems the guidelines layed out by INS now say that they have to consider the market conditions at the time of filing.

you got a true reply from your law firm. i am in the same boat. my application probably cleared SESA and is on the way to DOL but the DOL does not inform of this your lawyers and neither does the SESA.
 
can someone please help!

I would like to find out if my case has entered into DOL from SESA. Can anyone post the and to check for cases at DOL?

The Last time when i posted regarding my Labor Certification i got a reply stating that it would have already been approved ( Reciept date 10/25/2001) but when i tried to call my company they are telling that that they are recieving approvals only for April 2001. I even got a letter stating the following.

The Immigration Department has received several questions the past few months on the Labor Certification process at the Department of Labor (DOL). Therefore, to try and reduce the on-going confusion, we outlined the process below.

· MODIS files all labor certifications through the Boston DOL since that is where our head quarters is.

· Labor Certifications are first sent to the Department of Education and Training (DET).

· Upon receipt of the Labor Certification, the DET issues a receipt notice. The date on the receipt notice is your priority date. This receipt notice is only valid at the DET, it is not valid once the petition is transferred to the DOL.

· The DET reviews the application to ensure that the application meets the prevailing wage and the Reduction and Recruitment requirements. If the petition does meet both, the petition is sent to the Department of Labor (DOL). If the petition does not meet one or both of the requirements, a Notice of Finding is issued and sent to the company for response. Once the DET receives the response back, if the response meets the DET’s requirements, the petition is sent to the DOL. If the response does not meet the DET requirements, the petition is denied.

The DET does not notify companies or issue a receipt notice once the petition is transferred to the DOL. The DOL also does not send out a receipt notice verifying that they have received the petition. The DOL processing times on their web site reflect the date in which they received the petition. It does not reflect the priority date.

The Immigration Department will contact the DOL when we have not received a decision from the DOL on a petition that is past the processing time. All processing times are posted on our web site.

I read thru the doc you suggested, it\'s surely a good news for RIRs.
I have a question though for the following statement:

"The COs are allowed to consider these "layoffs" only if they are believed to have occurred within the six months prior to case review."

What\'s the "six months prior to Case review" mean, do they consider six months from the Priority Date(SESA) or Receipt Date(DOL)?

I thought, may be somebody else in forum has better understanding of the statement than I do. Any note would be appreciated.

I am new to this forum. I need someone to guide me. I got my LC initiated in March of 2002 from CT. My company said that it will take around 6-8 months to get LC done from CT in RIR. I was shocked to see that dates rolled back soon after that. Can anyone tell me roughly how long is it taking nowadays for the same?
