Hi,

Anyone from Boston (Framingham / Natick / Milford) area know where I can take photographs for 485 ? I took them from CVS and my lawyer says they are not good.

I need help following:
Recently, I joined a co. with my colleague recently got his labor approved and allowing to substitute for me.

But there are few problems, where group members
can guide me!

Company lawyer suggests that, it better to file a new
non-rir labor before - PERM kicks in. The argument for this
suggestion is -> this amendment for substation may take
more time and PERM can start before that. and later I will
not able to file non-rir cases, so not aplicable for 6yr
extention.



I have following question following this regard,

A) . How much time does a labor substitution takes:- with following differences in persons
a) diff in MS EE to MS CE, though job description is same, but approved labor is for MS CE. also experience
year and type is similar.
b) there was already an amendment done on this
approved labor for company change (due to acquisitions).
I was also working in same co with my colleague.

Will there an issue in substitution ?

B) Any Idea, when PERM will be implemented?
a) suppose, it is published on Jan 1, then it takes
120 days to take in implementation. so does it mean we can
still file regular (non-rir) cases till Apr 30 (120 days from Jan1).
b) Even with PERM, people can file non-rir cases, use
that for H1-B six year extensions.

C) Can I do following two things together:
a) due to PERM complexity, file a non-rir now
as well as
b) try to transfer available labor.

So, what I need help making decision is to take which route,

1) try substation and wait for its result, this will be good
if result of substation come before enough time, so that
I can file non-rir case.

2) file non-rir and wait for ..... years. (which at least gives
6yr extension stuff, as I have only 3ys left) and dint try
susbsitions.

so basically, decision will depend on ->
how much time labor substitution takes,
till what time we can file non-rir before PERM kicks in.

I will be really great full to all members for there
views on this.

My friend got his picture taken at a local store - and INS came back and told him it was unacceptable, that the pictures were too dark. He then went to a place in the Burlington mall (I think either Ritz Camera or Picture Plus), and the INS accepted that. Even though it was much more expensive (I think $20-25 for 2 photographs set to GC requirements), it would have saved him from a two-month delay in his approval - and in the long run, the two sessions ended up costing him more.

Make sure though that you show them the specifications, and tell them that if they come out unacceptable, you want them to retake the pictures!

One of my friends got the photo on Commonwealth Avenue at Boston University (near West Campus Greenline T station). The photos came out good and were accepted. The studio name is West Campus Photo Studio in front of EMS and City Sports. I am not sure about the exact address. I hope this helps. Good luck!!

RIR, or reduction in recruitment is the scenario where the employer has established that there is a reduced availability of workers for the position - they do this by showing that they've already conducted recruitment efforts that were unsuccessful. This helps in speeding up the labor certification process.

(you should note that due to the lag in economy in the past couple of years, many labor offices have been quite strict with processing RIR cases, especially those in the software industry).

Hi,

I just posted inthe SESA thread..thot fit to post here as well.

PD: jul 2002, filed as RIR
RIR rejected by DOL : may15 2003. case comes back to SESA, filed as non-RIR
Recruitment effor finished : aug 24 2003.
Results filed with SESA: oct 8 2003
SESA forwards case to DOL: dec 11 2003.

Going back a couple of pages, I conclude that there will be something to report in a couple of weeks or months, maybe :)
