RIR denials..

For all those fretting over RIR denials:
your RIR being denied means that you have been unable to make the case to proceed with labor certification based on Reduction in Recruitment. This could be \'cos the adjudicating officer deemed that the your company did not meet the criteria for RIR processing at the time of recruitment, or did not document it well enough to make the case with the INS. If your RIR application gets denied, it is NOT a denial of your labor certification, just a denial of your application to proceed with RIR. What would happen then is that your application would automatically be sent to the non-RIR queue, and you would have to proceed with normal non-RIR processing (advertizing job postings, soliciting resumes,conducting interviews etc.) A long process, but way better than denial. Being denied at the end of the non-RIR process is where you get into the hassle of NOT being able to reapply for six months. My 2 cents on the matter is: as long as the paperwork is moving (RIR,non-RIR or RIR turned into non-RIR), there is really nothing you can do but worry - and worrying is hardly productive given we have so many other stresses to deal with. Hang in there!
 
Does anyone know why DOL server has been down for such long time?

It is almost a week since the server was down. Does anyone know the reason? Thanks.

May be not!

I think the scrutiny on each case will be done manually using the docs submitted.... The downtime on the server may not affect their work. I didn\'t get the automated reply even today ... Our patience is going to make us Saints and we won\'t rejoice, even if we get GC!!!

I was going thought the Boston Board and found that you are very well informed person. My priority date is June 1998 . My labor was filed in New jersey and SESA approved the case and was recieved by NEWYORK DOL on Aug 23 2001. since then it has been a disgusting wait.
Can you tell me how I can find out as to how many cases are pending with New york DOL under detailed review. Any phone numbers and helpfull site. Please help there is no one responding in the new york room.

They picked cases of JULY & JUN in last few days....why so random?

  if you look back at last Thursday\'s Update, DOL screened one case from July 2001. below is the case:

1310708 Cabinetmaker 7/11/01 Reduct. in Recruitment Denied On 01/17/2002.

If you look at Tuesday\'s update they(DOL) certified a computer programmer having RD of 06/04/2001. below is the case:

01309845 Computer Programmer 06/04/2001 Certified -- FINAL ACTION On 01/22/2002

there are several other cases of JUN they already have certified!
  My question is what is the criteria at DOL Boston for picking up the cases from the Lot. How they pick the files....obviously by Hand...but...what standard they follow? Does it depends on Certifying Officer desk backlog, mood or LC seekers Luck?
Please provide your valuable knowledge on this matter!

They are definatly processing more than 1 case now a days..you might get a big one(update) tommorow for yesterdays(missing) and todays No\'s.

RIR certified yesterday

I just received email from Boston - ACU E-Mail Response System that my case got certified.

It seems that they processed more than one yesterday. My case 013080xx and RIR.
