is there a way to know, how many cases were recieved by DOL
in a particular month? whenever i call the DOL, they tell me
that number of cases rcvd in april\'01 is huge...however pikachu\'s
year end summary doesnt reflect that....please let us know ur comments.

Make sure you don\'t confuse DOL and SESA...

All the SESAs, everywhere in the US, received a huge volume of cases in April as the 245(i) deadline approached. However, because DOL receives cases only from the SESAs, the effect will be greatly spread out. Essentially every case received by DOL from about June to November (very roughly) will be a case filed at a SESA in April.

As such, DOL\'s burden doesn\'t increase much, but the delays do (suddenly the delay through SESA goes up from about three months to about eight).

If your case was really received by DOL in April, meaning that you filed it in January or so, keep watching the updates because you\'ll probably get looked at in the next month or so. 758 cases were received in April, of which 372 have not yet been adjudicated. (For comparison, there are 405 June cases, 413 May cases, 363 March cases and 23 February cases left. My case is almost exactly 1000th in the queue right now...)

How many cases in July and August untouched? My RD is at the end of August, I hope I could estimate how many cases ahead of me. Thanks a lot.
 
Good question...

I\'m only tracking cases up to June right now, simply as I have to cut off somewhere and that seems appropriate (by the time we start getting July cases I\'ll be off in the I-140 board, God willing!) But it\'s fair to imagine that there will be another 400 or so cases in each of July and August. So in all you have over 2000 cases ahead of you; you\'ll probably be processed this year, but don\'t count on it being any time soon. Best guess would be this fall.

Waiting Waiting

My PD in SESA is July 26, 2001. Well looks like atleast 2-3 month wait (optimistically:). Hope these Boston guys move faster and then I guess all of us need to take some risk and go for CP(looks like long way from here)......dont know how long my project goes on also.......job market sucks.....

Query regarding Prority Dates

Hi Marlborobell
   my LC application was filed in CT SESA on 16th April 2001 and was forwarded to DOL Boston on June 11. My question is, what would be the priority date at Boston regional office. 16th April or July 5??

Be careful how you use your terms!

Your \'priority date\' remains April 16 right through the process until you get your Green Card. It\'s significant if demand for Green Cards again starts exceeding the number available; then the date you started the process will determine when you are able to proceed through the final stages.

However, the date that\'s significant at this stage is your receipt date at the Boston DOL. If you have something saying July 5 (i.e. it took three weeks to forward your case from SESA to DOL, which is quite possible) then that\'s the date you need to keep track of.

At a guess, your case should come up in the late spring or summer.

If your SESA PD is July 26, you\'ll have a MUCH longer wait than that. If you\'re in Massachusetts, you won\'t even get into DOL for another six months or so (four months if you filed RIR), and then there\'ll be a wait of about a year before your case comes up at DOL. So don\'t expect any action in 2002. Other states may be different, but I wouldn\'t expect them to be enormously different.

thats disappointing to hear.....however last year my friends got both their labor and 140 (full process) completed in 12-14 months from MA,Boston and Vermont for 140 .......I hope we have the same kismat......

Kewl25: Not necessarily. About half the cases the DOL receives are for temporary workers (H-2A visas, I think), and they generally certify those in a few days. Why there is this disconnect between temporary and permanent labor certification I really don\'t know; I also suspect (though I\'ve never correlated to see) that the reason we see such disparities in the number of cases certified each day is that they do all the temporary cases in their pipeline and then only look at permanent ones if they have time.

Err... I know its a little hard to digest but reality is that they are doing March 8 - 18 cases right now.. They seem to have improved in Jan but you never really know.. It takes an average of 9 - 10 months right now for cases that were received in March 2001, up from an average of 5-6 months for cases received in Dec 2000..

Those 400 odd cases you see certified every month are temporary seasonal workers (cooks / ski tow operators / cleaners...) which are done in 10 -12 days.. For some reason, Boston assigns them the same sequence numbers. The permanent cases wait ..

Anyway.. my reason for this post is that I got my hard copy of the LC approval in the mail yesterday (at my lawyer).. At least Boston is fast in one department !!

I know RIR is faster as it doesnt require advertisement, 30 day wait....
 
What about all those denied cases

Would the most likely be temporary workers or permanent LC? Or maybe it\'s an equal mix? Would be interesting to know. As far as I know, the biggest risk to getting your LC denied is if you had major layoffs, etc. Otherwise, if you immigration lawyer did a decent job at the prep work, there should not usually be a reason to get denied. Anyone knows? I thought there was pretty high percentage of denied cases.

NEStory.. So far only 3 permanent LC\'s (from Jan 1 - April 30) have been denied.. Two s/w engineers and one faculty.. So its rare that you get denied.. It may take you a few months longer via NOF\'s but chances are you are gonna get the LC.
