Since, I submitted the RFI a month late.....If incase my petition for GC is denied.....I am assuming, I can still retain my Asylum Granted Status, stay indefinitely provided that I play by the rule…. worst-case scenario or am I being paranoid here?

yup. if your green card is denied for failure to prosecute you can retain your asylulm status. And you can also apply for your green card again. stop worrying and enjoy the holidays. :p

Dear Thankfu:

If we are denied, can we retain asylum status? or re-apply again?

You are asking about the I-485, right?

If it is denied because of criminal or terrorist problem or they believe you committed fraud on the asylum application, no you cannot retain your asylum status. As a matter of fact they will start the process to deport you from the country.

But if it is denied because you did not respond to a RFE then yes you will keep your asylum status. You can also submit a new green card appplication.

I think they don't "deny" your application per say if you do not respond timely but call it application "abandoned". I also believe that although they say it, they won't be that cruel not to let you submit RFE late. Your processing would be delayed but you would be given a 2nd chance.

Found guilty of crimes/terrorism is totally another issue.

So we do not need to worry as we do not commit those three crimes, we will get GC sonner & later, though stuck in name checking or background checking ( longest is 12 years as a friend of mine got his GC last month)

I don’t have criminal record… rather, am God fearing, hard working, trying to make it right here in my newly found land….LOL. Thank you everyone for your input, I was experimenting with sort of reveres psychology, if incase USCIS hits by surprise. Anyway, now I have a clear idea what to do next whatever the outcome may be. Thank you again.
