BEC Priority Date Tracker

There is no way they can send "All" 45 day letters in 4 weeks...I think what they mean is "they will send This particular" 45 day letter". OR "45 day letters for the cases entered so far" ...

well, BEC is supposed to finish to enter data by sep 2005. it was stated before. how? i don't know.although i think it will take at least another yr.hope i'm wrong.

what i know that all this process is a mess and a big mismanagment. u can expect everything weird from DOL.

which is right?

DOl stated before that they will finish data entry by end of summer 2005 so around september. icarus says that they will not finish before march 2006 which is what orissa's lawyer in phil BEC thread is saying too. honestly i don't know what is happening and what is the right answer. any one has any insights?

I talked to my atty about this. He said he could not verify this law for the former process (RIR etc). He was not sure if this was NEW for PERM.

1. Can you provide me the source of your information? Where does it state that you can use experince gained with your current employer for a different position with the same employer?

2. Does make a difference if it is in a different department? Example moving from Engineering to Mtking?

3. It is possible to re-do Labor for position after promotion : example: Engineer => Senior Engineer? Or Engineer => Manager?

4. Does the new position haveto have supervisory responsibilities or have to be a manager position?

5. How does the company have to prove it's 50% different? What type of evidence do they need to provide?

Your feedback is appreciated. Thanks!

To answer your 1st question:

Source: http://www.ows.doleta.gov/foreign/pdf/perm_faqs_3-3-05.pdf
The first PERM FAQ page 18.

Don't know answer to question #2 and #4

Answers to Question #5. I had a conversation with my attornies and they answered questions specific to my case.

To prove differences my attorney suggested using job descriptions (not job postings but internal job descriptions). It is obviously subjective - I guess that's why you hire the attorney.

I don't understand Question #3.

Hope that helps

one more up-date

Please update tracker with my info

Came across the immigration forums recently, ur all doing a great job guys.
Guess we can't do much but share and ease the pain.
Keep it up

Kindly add my info to the tracker.

STATE : IN
PD - 04/18/2001
CHICAGO DOL RD - 02/24/04
EB32 RIR
BRC Case # D-050071xxxx
45-day letter Date received: 05/25/2005

I am a newcomer

Here is my info.:

STATE : NY
PD - 06/11/2002
RD - Never get there
EB3 RIR
45-day letter: Haven't received it

Any idea when I am going to receive the 45 letters? I would say it is too optimistic for anybody to predcit a LC approval for 2002 PD considering I haven't received my 45-day letter. Of course, if they don't follow the FIFO policy, anything can happen.

I just joined the Forums: Please find my details for your tracker database:
