i did check this morning and it said "IN PROCESS"

2802 per year EB2 quota

So for EB3, total number available is: 40040.

Each country has visa limit of 7% of total number available and that is: 140,000 * 0.07 = 9800 including all EB categories + unused visa numbers.


Here is the math :
Total EB visas per year Worldwide: 140,000 (Worldwide)
Total EB visas per year to EB2 Worldwide: 140000 * (28.6/100) = 40040.
Total EB visas per year to EB2 to India: 40040 * (7/100) = 2802.8

If a family size of 3 apply for Eb2 visas then the visa avialble are 934.27.


Currently H1 quota is 65,000 world wide. The H1B quota in 2000, 2001, 2002 were 195,000 (http://www.murthy.com/news/UDhowlaw.html). But the quota was not completely utilized though. On average if there were 50000 H1B primary applicants from India . We can assume that there are atleast 20000 EB2 applications per year. Currently, USCIS is accepting PD Jan 2003. If someone with PD Mar 2005 (there were volumnous applications before PERM started), then he/she has to wait till the prior 40000 applicants are cleared. With 2802 per year EB2 quota, it is scary to imagine how long one has to wait. :rolleyes:

Unless the EB quota is increased (the chances are very low because the congress wants to discuss EB immigration under the CIR), the situation is unimaginable.

Lets hope that there will be a miracle.

PBEC moved approximately two times faster, but they are still behind (46% to certify versus 39% in DBEC).

Roma, the data is great and I have no doubts on this. Just a question arise in my mind. As per AILA - total number of pending cases are 142K where as your script shows pending cases as 127K. I was trying to understand why there could be a descripancy. One of the reasons - AILA data is not current. God knows.
 
The data you saw that is as of 12/11/2006.

One reason is that I don't have all the cases in the db. For DBEC I have ~140 and ~158 for PBEC . If we assume that DBEC and PBEC have the same number of cases it means that I miss at least 18k in Dallas. But the number should be more, because I am sure I miss some cases in PBEC as well. And their data could a week old, it would add another couple thousand cases.

I think the thing you should look at is the rate, how many % of cases are approved/in process.

Just read the following link on murthy.com - regarding he de-coupling of h4-h1 visa time, meaning when a h4 visa holder transfers to a h1 visa - she/he gets the full 6 yrs of h1 visa rather that only the balance yrs remaining on h1 status which they used to get previously.
this is good news for the spouse's of h1 visa holders, who had completed 6 yrs on H4 status and are waiting for their spouses EAD to be able to work now they can get a h1 visa for whole 6 yrs and can continue working after that hoping - by that time the primary spouse would ahve gotten his/her ead.

i am sure this rule will work out in favur of "h1" families.
