if you apply for h1 extension, and use this to obtain a stamping at the US consulate in India, then you wouldn't need to use your AP to come back in. Also you would have your H1 to fall back on , if there arises some problem with your pending 485.

Maybe you should talk to your lawyer. He might be able to better advise you on whether you should apply for extension, and use this to get a stamping to come back, or use the AP.
 
So finally my lawyers received the receipt(s) for my case. I have like 7 WAC#s between me and my wife - for 140, 485, EAD and AP. Registered online and LUD on 485 says FP received, processing resumed. Everything else is stuck at 9/8-9/9..

I think it is. I got my FP done as soon I got the notice. My appt was for 10/29. Now when I look up my case status it says results of FP were received and processing resumed. I am hoping this means I did not waste any time on my part...

Did you get an email notification when your I131/I765 were approved ?? My FP was done on 9/24 and there's still no update about the EAD/AP :(

Did your LUD change with a message 'your FP has been recvd and processing has begun on your case........' ???

RE 1 : Yes, I did get an email from USCIS. What was your RD/ND for EAD/AP ?
RE 2 : Yes, FP was done on 09/22 and LUD changed on 09/24 with the message ' your fp..' Sometimes it takes longer for LUD to change.

I'm in same boat with you. My FP was done on 9/23, LUD changed on 10/1 and no news about EAD/AP. Maybe we need to wait for a couple of days. :rolleyes:

I am also waiting for EAD/AP for my wife and haven't got them yet. The processing dates showing sept 7th but don't know when they will approve ours.

Looks like the pilot program is still on....so please keep up your hopes. I think (of course this is just my guesswork) if the case is straighforward and the FBI checks clear fast they just approve it and don't bother about EAD/AP. My lawyer did say though that it can take upto 120 days for clearance and approval.

Its been a long journey for me and a real relief now!

Any EB2 guys NOT in pilot program?

I want to know if someone who has applied as EB2 from CSC after May 1, 04 and NOT considered in pilot program.
My guess is they are not differentiating between easy or hard EB2 cases for selection in Pilot program. Legally they cant do that. Some guys might be receiving approval before others depending on whether name clearance, fp clearance etc is completed or not. But i think every body in EB2 is in pilot program after May 1 in CSC.
Correct me if you think you know any instances where EB2 person is not considered in Pilot program after May 1,04.
