I140/I485 filed on August 20, 2003.
I140 approved in June 2004.
FP notice received for SEP 14, 2004 at NAPERVILLE, IL.
I485 ???? :confused: :eek: :( :mad:

Pl. share early FP experience at Newark

Does any one has early FP experience at Newark. Mine is in mid of Oct. Planning to try early FP. Pl advice...

Advanced Parole question

Hi,
While concurrently filing for my I-140 and I-485, I did not apply for my 'Advanced Parole' since I had a valid visa and I did not forsee any chance of going outside USA.

But now, I have to go outside USA but my visa is expiring soon.
My attorney says that 'since the Advance Parole is not applied during concurrent filing, it will take minimum of 3 months and anywhere to 6 months?

Is this true? Is there anyway we can expedite this process?

I-485 RD: 08/22/03
FP Appointment at Newark: 10/05/04

Any leads on this topic is highly appreciated ......

I've seen some recent reports of people getting their EAD / AP in 2 weeks or so but I don't know if they are taking longer on average. I don't know if it matters whether you file for AP at the same time as the I-140 in terms of the processing time. The processing date for the I-131 (AP) at the VSC is 9/13/4 so it *sounds* like they barely have any backlog if we can believe that number.

So presumably you are switching to an EAD? Is your current status H / L and you can't renew this because you've used up the 6 year limit (otherwise you could just renew the H / L, no?). And, obviously, if you switch the an EAD, you'll have to make sure that doesn't expire or you are SOL. Make sure you renew it at least 2 months before it is set to expire (although, again, it sounds like in some cases EADs are only taking 2 weeks to renew now).

I did'nt quite understand your question about the EAD's. My 2nd set of EAD is approved and it is valid till end of 2005. I don't have any issue with EAD.

Since my visa is expiring, instead of applying for H1-B visa extension, I should take advantage of Advance Parole ..... right ?

What will happen, Even though I have a valid EAD card, if I do not apply for Advance Parole and my existing visa expires, WILL I BE OUT OF STATUS ?????

Finally, how long does it take to approve a FP ? And after the FP is approved, how long does it take to get the actual 'GC' ?

OK -- it sounds like your EAD is in order (in my case, if I was to start using my EAD -- I'm on an H now -- I'd have to renew the EAD within a few months since it's only good until 02/05 -- I was worried you were possibly in the same situation).

It's up to you. If you can renew the H (not at 6 year limit), some people prefer to do this so they have a status to fall back on if their GC is denied. If you think that is unlikely, then use the EAD (and get AP if you need to travel).

Your status if your H expires is still valid -- you are in "adjustment of status" status as long as the I-485 is pending and the EAD allows you to work. The only issue is if you need to leave the US then you need AP or your I-485 will be considered to be abandoned and you won't have any status to re-enter on. If you don't need to travel, or if you extend your H (you can reenter on H or L status without AP) you don't need the AP.

Most people's FP takes about 6 days from the day the prints are done. The online message should change to "FP received, processing resumed" or something like that after 6/7 days.

The other issue is your namecheck. See the information elsewhere on this forum on how to send a fax to the FBI to verify that this isn't being held up. Apparently most of the time the USCIS will ask for the namecheck upon receiving the I-485 and it should normally only take a month max. If there is a "hit" against the FBI databases, some people end up waiting 18 months or more for this to clear and it is possible to ask the FBI to expedite your namecheck after its been held up for a while.

With your ND of 08/22/03 I'd assume that it will be at least another year although a small number of July/Aug approvals have shown up (e.g. see rupnet or look in the I-140 2003 tracker) so if you are lucky, you could be approved any day. I'm in the same boat (ND 10/23/03) -- definitely frustrating not being able to count on when the GC will be approved...

Someone posted a sample letter on another thread. For the return information, I think you can put *either* an email address *or* a fax number (I just put my home email address on mine). I believe they are taking 3-5 weeks to process these currently.
