OK -- it sounds like your EAD is in order (in my case, if I was to start using my EAD -- I'm on an H now -- I'd have to renew the EAD within a few months since it's only good until 02/05 -- I was worried you were possibly in the same situation).

It's up to you. If you can renew the H (not at 6 year limit), some people prefer to do this so they have a status to fall back on if their GC is denied. If you think that is unlikely, then use the EAD (and get AP if you need to travel).

Your status if your H expires is still valid -- you are in "adjustment of status" status as long as the I-485 is pending and the EAD allows you to work. The only issue is if you need to leave the US then you need AP or your I-485 will be considered to be abandoned and you won't have any status to re-enter on. If you don't need to travel, or if you extend your H (you can reenter on H or L status without AP) you don't need the AP.

Most people's FP takes about 6 days from the day the prints are done. The online message should change to "FP received, processing resumed" or something like that after 6/7 days.
The other issue is your namecheck. See the information elsewhere on this forum on how to send a fax to the FBI to verify that this isn't being held up. Apparently most of the time the USCIS will ask for the namecheck upon receiving the I-485 and it should normally only take a month max. If there is a "hit" against the FBI databases, some people end up waiting 18 months or more for this to clear and it is possible to ask the FBI to expedite your namecheck after its been held up for a while.
With your ND of 08/22/03 I'd assume that it will be at least another year although a small number of July/Aug approvals have shown up (e.g. see rupnet or look in the I-140 2003 tracker) so if you are lucky, you could be approved any day. I'm in the same boat (ND 10/23/03) -- definitely frustrating not being able to count on when the GC will be approved...
