No unless your LC is qualified for the EB2. But you may consult your lawyer about the possible EB3-2 that is still available.

Hi Compiler/all

Do you know how this visa retrogesson & PD's would effect LC filed under EB2 category?

case moved to Philadelphia BRC

I had my university intl center lady call the DOL and she said that my LC had been sent to the Philadelphia BRC. Does anybody have info on that center or has anybody had their LC done there.

Is your case EB1 category ???

no EB2

I am in EB2.. My details:

Received in NC SESA: 05/21
Forwarded to Atlanta DOL: 05/27

TOday (12/13), my univ. called the Atlanta DOL and the lady said that all the cases after April (or somewhere like that) have been forwarded to Philly BRC.

My intl center female is an ass, so dont take this as 100% accurate info.

tracking question

All people whose cases are in process with Atlanta DOL, did you receive a tracking number before they adjudicated your case through a letter from DOL?

Or, did you or your lawyer figure it out by calling DOL?

thanks.

tracking number means...i believe you are asking about case #.
Yes, we recd case # either through our attorney or thru AVM using company phone #.
In my case i recd thru attorney and also thru AVM as i kept trying...trying everyday until i got my case #.

pragir,
did you not get a NOF? I think I saw some post like that from you, how can they move the case that is already opened here in ATL DOL to BRC in Philly, they are suppose to send only the unopened cases to the Philly BRC. Dude at this juncture do not scare with info like this I just sent my response for NOF on 9th of Dec and checked the Fedex Tracking that says that the papers were received on 10th of Dec.

I am hoping my case should be certified sometime this week so I can file for 140/485 concurrently, else :(  :(  :(

These crazy DOL people are not updating the AVM, actually the number is also not picking up, it just keeps ringing.

Retrogression effective date

Hello All,

Is there a date from which retrogression will be effective. My understanding was that it is effective immediately i.e. anyone from now on cannot file I-485 until PD reached their date. Is that true, or is it only from Jan 05, which means anyone who gets an approval this month gets lucky.

I thought I read somewhere that even people who have already concurrently filed will have to wait for PD to reach their date before a I-485 approval, am I missing something?

- Dru

Dru,

The effective date is from Jan 05. Before this date we can apply for concurrent processing. Only thing is they can apply but the I-485 can not be processed until PD reaches his/her dates.

You are right about already applied cases also I-485 won't be processed until it reaches the PD dates, but this is also effective from Jan'05. Before Jan 05 there is a possibility for already applied cases may get the approvals.

Thanks,

I'm shocked. You mean April 2004?

Anybody heard similar news? Gp111, what's your thought on this?

my bad on NOF

I messed up on the NOF stuff. I have not gotten a case number as yet, so I was trying to hazard a guess using my university's phone number. But, turns out the NOF was for somebody else at the university.

After pestering the intl center female, she told me that she had called the Atlanta DOL about my case, and the person there told her that my case (and other filed in Atlanta after April 2004) had been sent to Philly BEC.

So, that the situation I am in. If anybody could show me a way in which I can get a case number for DOL processing from my SESA number I would be eternally grateful.

dol processing times sanity check

Dont go too much by the processing times. You never know when you will be lucky. I know 2 cases both EB2 RIR. One went in in Feb 2004 and was certified on June 2004 and the other went in in March 2004 and was certified in June 2004.

It just depends on your luck. Mine went in a couple of months late, and am stuck now.
