?? on RFE vs. NOF

What is the difference between RFE(request for evidence) vs. NOF (notice of finding)? If one gets NOF, which I saw in Savitha_76's case, does that mean denial of RIR and it will be kicked into regular/Non-RIR?
 
Please read other postings regarding NOF.

Its Intent to Deny the LC, but in my case it was issued b'cose it did not match the prevailing wage, since the DOL have increased it recently.

My employer had revised my wage and has sent the application back to the DOL. Hopefully it should get approved from what I heard from my attorney.

I received the call from attorney that the atlanta service centre is asking to rearvertise. Could you know how long this might take.
Also are there any other options ?

based on the DOL guideline, if they believe there is an industry layoff, they could ask to run ONE additional ad. It is better than getting a denial or being kicked into non-RIR.

Can you let us know what field your job is? Is it IT related?
 
How many ads did you post in the past?

I wonder why they asked you for new ads? Do you mind telling us how many ads you posted for how long?

Finally Certified!!!

I checked the AVM this morning and my case got certified.

Here are the details:
Received FL SESA : 3/15/02
ATLANTA DOL Received : 4/11/02
Remanded to employer : 9/13/02 (Letter Dated!)
Employer sent back response : 9/30/02
Certified : 10/2/02

Remanded to employer? Does that mean they ask for new evidence? Could you tell us more details of this part? Then how did your attorney apply?

My attorney says that my company has placed add on the magazine or daily new paper which is not local. eg daily news or metro paper. Those add the Atlanta Labor Dept is not accepting.
So, the attorney says either the company has to place the add for 6 months or the case will be send to state dept for NONRIR. I am right now working with the company for all possible options.

My company has branches in about 30-35 states.

Following are the options I have.
1. Request company to place the add for 6 months.
2. Transfer to NONRIR.
3. Start new processing from the state where dates are current.

I am not sure which one will be best.

Please advice.
 
Any one from NC SESA who got approvals lately

Anyone who recd any approvals from NC SESA recently? can U please update or give an idea as to when recd the last approval?

Came back for further information
Sent back in with RD March 26, 2002
AD September 26, 2002
Now to start with the second process.
This forum is great help, keep up the good work.
This site got me through my original H1 approval. This is an awesome support group.

Thanks for sharing your information with us.

You should check with your attorney and see if you can do less time for the ad. Some company require to do 6-month, but a lot of people don't do that long. So I don't know if this is more like attoney's and company's decison and not DOL's requirement.

Also see if you company can do LC in another state while you are posting ad in your current state. If not, you may just do 6-months and wait. It is still better to put back to non RIR. You never know what is going to happen to non RIR cases. NC is still processing cases in april 2001.

Mine got approved aug 26, o2 at NC sesa, RD at NC sesa was june 01.. RIR, got a query at NC sesa on Aug 10th, replied aug 20th..

mohan raja, when is the date for your case in ATL DOL?

I just wanted to know how quick they input them into their system.

I just have 1 year 3 months remaining on H1-B 6 year period.
My attorney says that i need to file new application, and she also says that for RIR the company has to place 6 mnths add then only the application can be file.
does anybody know how long the company has to place the add for NONRIR cases. I heard just one add should be sufficient. Is that true ?

The attorney also says that lots of RIR cases are getting rejected or being queried becuase there are lots of Green card and citizens looking for the job.

Does it make sense to file in NONRIR ?

Please advice.
