RIR or Not RIR at Atlanta DOL

Hello,



I got a query for Job Ads from NC SESA,my lawyer submitted the required documents and application was forwarded to Atlanta DOL from NC SESA recently. Application went in RIR processing time.

I was wondering if any one can share thier experieneces if
they had before..

1)Are my chances are high for a query or NOF or RFE or Denial at Atlanta DOL since I got a query at NC SESA state
2) what are chances for moving back to NON RIR at Altanta DOL

atl01, what did your attorney say exactly about speeding up the process in ATL DOL?

No offend, but still want to check with you on that? ATL DOL is still working on March cases, it's been 2 months.

There must be a lot of cases in that time frame. They used three or four months to finish up Feb cases.

If the same situation happens to the cases in March, April, May ect, the processing time will stay same (6 months) or worse. This could happen since our cases were sent after 4/30/01, we are always behind those 245i cases, in SESA and DOL. The processing time won't get improved in future unless ATL DOL really have a new plan.

Just want to know if they mention what they are going to do to speed up.

It is OK to ask me.

My lawyer wrote an email saying that "we received a report indicating that the Atlanta US DOL office would be initiating new efforts on 10/1/02 to speed processing of RIR labor certification cases". I don't know the details of the "efforts". Since it is effective 10/1, the improvement is yet TO BE SEEN. The update only reflects the processing time checked as of 9/17.

It is bad that we don't know how many cases are pending at DOL. But why do you think the 245i cases should further delay us in DOL? Logically, 245i created huge bottleneck at the SESA level. As long as SESA is releasing stable cases downstream into DOL, by the time our cases are in DOL, the 6 months should not change much even if no improvements are made. Do you agree?
 
atl01, thanks for your reply. It seems like they will do something better.

Here is my logic. There were much much more cases sent in April, 2001, especially in the last week of April. The number of cases in those few days could be three times more than the totals from Jan to Mar. However, these tons of cases were just recently sent to ATL DOL, will they further slow down the processing time? Could this mean the bottleneck in ATL DOL just get started?

I hope I just worry too much. But ATL DOL is moving also slowly on March cases.

Based on what you posted, it sounds like they may implement a more effective process procedures. Let's wait and see what is going to happen after 10/1/02.

I filed my LC with GA SESA in May 2001. GA SESA has been working on April 2001 cases ever since June 2001, which they only had 2 months backlog then. Now a year and half passed and they are still working on April 30 cases. But the earlier April cases should have reached ATL DOL throughout last year and this year. My case has not been cleared out with GA SESA yet. It will probably reach DOL some time next year. That is why I think April 2001 cases should not create a backlog in DOL, because they started to flow throw DOL since June 2001.

I partially agree with atl01 ... It should not problem at DOL ....
But it surely slow down processing speed at DOL ... because they might receive handful of applications from all SESA.

One week back, i checked status with AVM, latest approval i heared was received on March 19.

It seems they received lot of cases on March 20, March 26 ...

Any updates ????

It seems they r processing March 20, 26 cases ... I heared latest approval case 04386990, recieved on March 26, AVM updated on Sep 20.
 
what I found out about processing time

Thanks to GC412's idea and case number provided, I tried 20+ combinations of case numbers and here is what I found out:

I checked the case # 04386990, all I heard is that it was received on 3/26/02, it did not say approval on it. But let us assume that it is the most recent approval.

I found the latest case #, at least based on the available updates on AVM, was case # 043-92603 with RD 9/10/2002. That means there are 5,613 cases outstanding assuming the case numbers are assigned in 1 increment. Whether the case numbers are actually assigned in 1 increment or not, we can gather more data and prove it.

Here are more VALID case numbers if you are interested to check later:

Case # RD:
043-88000 5/2/2002
043-88500 5/17/2002
043-89000 6/6/2002
043-90000 7/11/2002 certified on 7/15/2002
043-92000 8/27/2002
043-92500 9/10/2002
043-92600 9/10/2002
043-92601 9/10/2002
043-92603 9/10/2002
043-92604 + not a valid case number or another possibility being that AVM has not been updated since 9/10/2002.

Another observation is that it seems that there are about 1000 cases received in a month based on the data observation above. For example, from 5/2/2002 - 6/6/2002, from 6/6-7/11 and from 7/11-8/27/02.

Am I a good detective or not! If some of you do the similar "silly" things as I did, we can compile a statistic report for ATL DOL.

LC re-filing in GA

Hi folks,

My company had me relocate to Atlanta, and I am now an official Atlanta branch employee. My LC was filed in Apr 2002 out of Vermont centter as I was working with Boston office then.

Would it make sense, and how much time might it take, if I just re-file my LC asap with GA given the facts that there might be address change confusion (both with my company branch and myself) when I go in for I-140/485?

Any suggestions to avoid the refiling if it can be avoided? And any ideas how many days it takes for the LC to get cleared? I am more interested on getting to my I-140/485 earlier so that my wife can get an EAD.

Let me know.
 
Re: never go to GA if you can

My LC is filed with GA in May, 2001. GA SESA is still stuck on 4/30/2001 cases. It might take another half a year to clear the backlog. It is very unfortunate that you relocated to Atl, in the perspetive of lengthy processing time with GA SESA, ATL DOL and 485 with TX INS.
 
Atl latest approvals...

Just to make you people feel better... I've just checked the statuses for latest ATL DOL approvals... They already have some Apr 1st cases approved. Any confirmations from real applicants?
 
Hi,

It seems ATL DOL still processing some cases, who received on March 26. Of course, they processed some of March 29 cases and April 01 cases too ... But, it looks like they received more than 200 cases on April 1st.

Hope, They can catch up speed...
