I am in the same boat as you, GreenMD2003

I was told by my lawyer assistant that my case was hold at the state level instead of regional office for regional level processing. The contractor are doing the case for us.

We have no idea about the schedule. Can we call the regional office by ourself to get more clear answer?

Moved to FEDERAL But no Case #

GreenMD2003,

My case was moved to FED in May2003, have a long time to go than all of you guys. But just wanted to let you know, that I don't have a case# yet, its been six months since.

Case#'s have been delayed due to some reason!

Received at SESA : Oct2002.
Moved to FED : May 2003.
Expected : Time will only tell!

Did your lawyer talk to your state SESA or ATL DOL? When did your transfered to regional level? from which state you are processing your LC?

How do you say your case number have been delayed? Did the DOL told that your case don't have case # yet?
 
Why no case#

Hi Tamil_GC,

My attorney says so. They did speak with the assigned officer to the case and was instructed that, due to heavy load, even though the case was forwarded to the DOL, DOL does not necessary issue a case# as soon as they receive the case from SESA.

So the only way to get a case# from DOL, is to constantly check - not more than 1 query in 15days, by fax or talk to an assigned represensative - if one was assigned.

Catch22, but i am being told so, I have no option but to beleive them.

Ofcourse, only the Attorney or Firm's representative can do this.

case number ?

One of my friend got his case fwded to ATL DOL Dec 20th 2002 from Florida SESA and still does not have case #. His labor was filed through famous leading attorney and he believes that attorney for some reason does not want to provide case # to my friend. We tried AVM using phone # provided in labor filing , but AVM says "phone # not known". Is there any other options to find case # other than approching attorney ?
 
Hope the following is helpful. My case was fwd'ed to Atlanta from Florida on Dec 27, 2002, however until sept my attorney had no case number. My employer started calling Atlanta and they said they havent received the case. After several calls to Florida they transmitted my case again to Atl. Now i have my case no starting with 0440 and when i check the AVM it says received on Dec 27 so I am happy it will be processed as per the original priority and no time lost.
 
Guys,

My case was Remanded back to employer on Nov-18, 2003.

I called my attorney and he hasn't received anything from
DOL yet. He says don't worry I will take care of it.
I am crossing my finger and hoping it to be some
minor clarification that DOL requires.
I hope they are not asking for additional Ad because
that might take another month or two.

Any thoughts on different reasons for Remanded to employer???

Will it be done faster or slower?

If file get hold at state office after approval and Insted some officers from regional will come and cerify few cases
at state office itself.

In a random check, I found this one.

So I guess they are processing end of november cases.

My case is with the same DOT code
recd date: Feb'6,2003.
 
Labor approved

Labor approved for someone in my friend company. Details are
Case fwded on Nov 26th 2002
Approved date Sep 30th 2003

My case fwded to ATL DOL on July 11th , Got case # Oct 23rd...Long way to go.... :-(

Most of the time US DOL put the case in status of "remanded to employer" for insufficient advertisement and/or recruitment effort. I guess, your attorney and company can take care of this problem. You will not loose any time othar than the time which you will spend on reply this query.

Remanded to employer....

You should be fine UDUTTA... I know quite a few instances where this happened and the issue is typically, small corrections etc...I think they are giving a chance to the employer to correct the mistake and resend... which indicates to me that there is nothing to worry. It is just some lost time, like a month or so which is probably trivial when you see the total time...
