Job descr: Requires Masters degree + 3 years work ex.

I heard it is the DOL who finally determines whether the application qualifies as EB2 or EB3.

My lawyer said there is no way to track the application. Is that true? I have read various posts here that suggest otherwise.

I have a bizarre case where my employer filed for PERM under EB3 in January, 2006. According to the HR, it got denied because they didn't look at the addendum attached to the application. This was an e-file. The lawyer responded to the denial but haven't received anything after that.

I asked my HR to provide me with the case number so I can check the status myself. She says that the company has filed multiple labor application in a bundle so if she gives me the case number, I would be able to check other employee's case status. Is that true that they can file bundled labors? I have never ever heard of this before and was wondering if anyone here has heard of this.

Is there any way I can find out my case number.

EB3 or Eb2

I have a urgent question, need all of you to help.

I have a masters D, working in biology department of university, as a research scientist I, Before I hire a lawyer from the university he agreed me under EB2, I paid the downpaymentfor $3000, and after a month, I called them for asking the current process. They asked some question about job title and job description, which looks just want to start my case. I am so mad with them, and enen they told me my case only can go EB3 since the HR job description required the B+one year. they said I only can go with eb3, on other choose. So upset for me.

I have a app with them this afternoon, could you please give some suugestion, do I following them go EB3 or I just withdraw my case from them.

If the HR can support by giving the job description which requires masters degree, then you can file under EB2. If the HR remains adamant and doesn't budge, then you are stuck with applying under EB3.

However, since you are in the research field, if you can get into a Phd program, then a lawyer can file your case under EB1 which is reserved for scientists, upper management positions, and scholars.

Dealing with stubborn HR department is the story of our lives.
 
What is Average timeline for Perm Approval

It has been 75+ days so far.My Lawer checked the status it says IN PROCESS.

Question concerning non availability of Birth certificate

Should the person giving the Affidafit be living in the same city as your birth place? Or can they be living in any city ?
I was born in Vizag and my parents moved to Hyderabad when i was 2 years old . I do not know any relative living in Vizag since most of them are in Hyderbad .Can they give me an affidafit ?
Ps my passport states I was born in Vizag

Thank you so much for your detailed information. Now, My lawyer agreed to contacted the HR again. But she said if HR proved to go EB2, after that another issure will be coming up for Prevailling wage, since University pay is very low, and she guess the prevailling wage will be 10, 000 high than what I got now.

I am waitting for the results from HR, If they agree, and I will begin to deal with the prevailling wage. Could you please give some idea for how to explain to my boss to sign paper.

Alternate education approvals under PERM

I have posted this message in another forum but wanted to repost in this one as well. Wondering if there are any approvals with alternate education for Eb2 under PERM. My labor is currently going on with Atlanta center and as several others I am waiting for a decision.
I have MS is Chemical but working as software engineer \IT specialist since I graduated 5 years back. My PERM is currently applied as MS+1 year as per my attorney’s suggestion,

Curious if there are any approvals with similar situation? Any suggestions appreciated.

Total time taken for approval: 137 days

Sponsorship e-mail questionnaire was received by my employer in 3.5 hours after filing PERM. Employer replied affirmatively immediately. After that, there was no confirmation e-mail (stating that case will continue processing) was received by my employer. My case is an example to prove that it is a non-issue if confirmation e-mail is not received after responding to sponsorship e-mail questionnaire.

I have recently filed for conversion of my backlog case to PERM. My PERM was filed on August 25th and my attorney did recieve a case #

Now when I check the backlog case status online at the following link.
http://www.pbls.doleta.gov/pbls_pds.cfm my case status says withdrawn.

is this normal that they withdraw my backlog case first even before my PERM is processed.

As soon as PERM is filed with a request for conversion from BEC to PERM, the BEC case is automatically withdrawn. No wonder why your BEc case status says "withdrawn" for your case. Just hang in there and wait for your PERM approval now.

After PERM application is filed, a sponsorship e-mail is sent by DOL (usually with a few hours to two or three days) to the employer (not the attorney) asking the employer to click on a link which takes the employer to a webpage with a sponsorship verification questionnaire. The 4 questions in the questionnaire are:

1. Are you, or do you work for, the employer referenced above?

2. Are you aware that an Application for Permanent Employment Certification was filed on your behalf?

3. Do you have an opening for a (job title) in (location) ?

4. Are you sponsoring (worker's name) for this position?

Note: The email also references the position by the OES title.

Failure to respond (online) promptly to these questions by the employer will result in a phone call from DOL to the employer (usually within a week or two from the date of PERM filing) on which a DOL representative will ask the above four questions. The employer's contact person will need to be able to take the call and communicate in English and must respond affirmatively to all the 4 questions for the case to continue processing. If sponsorship check fails, PERM case will be automatically denied by DOL.

Note: Experience of forum members indicates that if a PERM case does not receive the sponsorship e-mail from DOL, it usually gets denied within around two weeks from the date of filing. This denial is usually automatically generated by the PERM system due to some very basic technical error in the PERM filing. If your PERM case successfully passes all the inital automated checks performed by the PERM system, then expect your employer to receive a sponsorship e-mail questionnaire. In summary, employer not getting this sponsorship e-mail after PERM filing is indicative of a sure-shot automatic PERM denial.

My Employer confirmed that they got the sponsorship email the same day when it was filed and they replied the same day.

My labour application through PERM got approved in 6 months. Initially got a query and was sent to the Atlanta processing center, it took 4 months in the Atlanta processing center to get approved.

How long have you been waiting? I have been waitng 3 weeks from now...it says in process.
