hi guys
congrats on your approval. Can u share more info about your case details ?
Actually i m in the middle of my PERM process. Shooting for EB2 with job title Sr. DBA and MS+1/BS+5. Job order already in place and website ads also placed.
Now my lawyer says to drop the whole thing !! Because he says that EB2 in IT is only possible for the title of CIS Manager and nobody else :( :(
Please help.. i m in a desperate situation.

Hi 4evernp

My PERM labor has been filed with the Atlanta center. It got approved on 09/13/05. Yesterday I also got my approved PERM application from my attorney that need to be sigend by me to file my I-140 and I-485 concurrently before 09/30/05.

Here are my case details:

Title: Sr. Software Engineer
Minimum requirements : MS + 12 month exp (it was on the PERM application)
Prevailing wage : $ 66,700.00
PW source : OES
State : Mayryland

Do u have a copy of the Prevailing Wage Determination or do u know what was ur SVP code and Job Zone. My PWD is also the same. (approx. a little less than $ 66,000)
My lawyer says that with the job zoen and SVP that GA Dep of labor has determined for my job title will not fall under PERM EB2 !!!

Hi 4evernp,

I have seen the SVP code also on my PERM application that I have signed on it yesterday. I don't remember exact SVP code but I can tell you tomorrow since have a copy of it.
 
eb2 questions

1) the ad that my employer has given, is very generic
it covers all software engineers (whether 0 or 10 yrs)

is it good enuf?

2) my job title is software engineer

does it help if i specify senior software engineer in perm?
(i saw many SE getting EB2)

3) my employer has to prepare business necessity letter

is this the single most thing important for perm?
what should be the format?

Moreover can u tell me on ur labor appln or ad .. what have u mentioned for the question how many people u supervise ? If you have u a copy of ur prevailing wage determintion then u would also find the job zone over there.. is it 4 or 5 ?

I don't have a PWD copy with me. But whatever I have said in my previous posts that was there in my PERM application that was approved by Atlanta center and that has been send to me by my attorney to sign. One thing I can tell you, I can check the question that you have asked whether it is there or not on my PERM application.

I just checked with my attorney. All parties (Employee, Employer and Attorney) need to sign the certification letter.

You can send your medical documents at later time when you get an RFE. I read it in some other forum. Please check withyour lawyer.

I need to know how an EB2 case can be approved without problems

please tell me ur
1) job code /zone
2) what did job description look like
3) what did business necessity letter look like, or how u proved that MS is a must for this job description

I have asked my lawyer to file I-140/I-485 for me concurrently no matter happens. Looks like the printout can be used and the original approval can be submited before 10/31. :)
 
you can file without the hard copy

xxw106 is right. I filed it with Faxed Copy from DOL. We also attached the printout of the screen, search results where it says my case was certified.

Filed it yesterday, fedexed it just in time.

You should give it a shot. Use same day service with Fedex.

I am in the middle of PERM EB2 process.. MS + 1 for Sr. DBA. Now m lawyer says its not possible and wants to revise the process to EB3. All the recruitment almost done :( :( :mad:
i want ur help.. may be if i can get ur case specific details then that would hoepfully convince my lawyer.. please respond i would really appreciate...

to refresh ur memories... i m in the middle of the perm process eb2.. and my lawyer now says that for my case eb2 is not possible and wants to go with eb3 now.. so restart again .. with the priority dates in such a mess i dont want to do that.. he says in the IT field nobody is approved in eb2.. :(

i just want to bring forward as many cases and details i get for those cases for eb2 in IT field.. Please helo :confused:

well

he must be blind

because i have seen 10-20 in immigrationportal forums alone having successfully certified in perm EB2 with simple title as "software engineer"

it might be hard, or chances of audit /scrutiny might be much more

but a good lawyer should be able to pull this off
