asylum in legal status

I applied asylum in my 4th legal entry. Asylum officer told me to collect my result after 14 days but I am still waiting for my result after five months. I think that the officer has locked my case because he has sent my case for security check. Can any one tell me that how long do I have to wait for my case , if my case has been sent to security check.
 
Asylum in legal 4th entry

My case has been locked by asylum officer for security check. I got my EAD etc. Is it good to go to asylum office to know the status of case. Some of my friends suggest me not to bother them. I am waiting for result since last six months. Can any one suggest me, what to do in this condition?

I don't think there is anything you can do exept wait. But one thing I was curious about is that if you were in legal status when you applied for asylum, they should mail you the decision letter. I think only people who are out of status go to the office to get their decision. Are you sure it wasn't mailed to you? Just thought!

I don't think it really metters if you are in legal status or not. Security check is one of those things you can't really do anything about. It is true for asylees and it is true for those who apply for adjusting status - it can be up to 2 years.
 
What a terrible way for things to go. I would definitely do whatever I can to find out my status. I mean, people like me who are in Asylee status already feel like they don't feel right because of the limitations, How some a person with no knowledge of their status feel? What if you are in a situation where you need to prove your status, what do you say your status is??? I see do whatever your can to find out... having a pending case for a long time is never a good year. You know as years go by BCIS makes it tougher to get into particular status, you don't want your case to be limited to a catergory based on some new immigration law in the future. Find out now, it may be good news, or you maybe in a better position to fight the decision. Good luck

PS: It's almost as if an EAD card is supposed to give you some type of security or silence you. You want a defined legal status.

Have you ever made an inquiry of your case? Are you stucked in FBI name check?

What I was refering to was about the officer telling him to "collect" the decision and not about the security check. Yes, security check is for everybody (legal status or not). But he said he told him to "collect" meaning he needs to go and pick up his decision. I was trying to say that maybe they mailed it to him and he didn't get it somehow. And that he just went to the USCIS office to "collect".
 
Actually, after my interview they told me to pick the result after 2 weeks but when I went there to pick my decision, the lady at counter replied that they will mail the decision to your address within a month but if you don't receive the decision, you can come to this office to enquire about your decision on any friday. But I never went there because some of my friends suggested me not to bother them and wait for the decision at home.

Well ,I think you should go and check. If she told you to come back and pick it up, I don't understand why you listened to your friends? Are they lawyers? I mean it's probably sitting on someone's desk and collecting dust. I hope you will find it. Why don't you go now and see what's going on since she said you can come on any friday?
 
What means DON"T BOTHER? You have to know... May be they have sent your case to the court and you are not aware of that? I would go there every friday to figure out. I wish you the best.
 
It can be two days or 2 years. There is no correct answer. Some people are lucky and some get stuck for ages.

Can I request them to give some update over net. If the case is locked, can they update my case status online or not because everytime when I search my case status, it says case status ret. fail.

I don't think you can check asylum cases online. I might be wrong, but as far as I know you can't. Just go to the office and ask them about the decision. Why are you reserved about that?
 
I am now in my home country without taking permission from asylum office because there was an emergency at my home front. My asylum case is still pending. I have still valid B2 visa. Can I enter again ti US or is there any problem while entering. Can I ask for asylum at the point of entry if the immigration officer restrict me to enter in US? Any can give me good suggestion.

I believe if you departed the US without permission from the asylum office you may not come back to the US to resume your pending asylum application. You needed to obtain advance parole. You can try and enter on your valid B-2 however, you will most likely not be able to do so because the intent of a B-2 visa is a temporary visit to the US and you are certainly coming to the US to resume your asylum application. Therefore, I think your chances of being admitted to the US as a B-2 visitor are slim.
 
Your B-2 visa is no longer valid to enter the U.S., you can try, but you will most likely be placed in expedite removal at the airport. The airline personel may will let you board the plane but the officer in the US will deny you entry since you are not coming to the US for a short visit.

Even if you try to claim asylum at the port of entry once they deny you entry at the airport, the officer at the airport wont believe you since you claimed asylum, then went back to COP and now you come back... (Im sorry, but it seems that your fear of persecution is not very real). Now, you may have your motives for going back, but remember that at the secondary inspection you will be screened for fear of persecution, and a low level immigration officer will spend and make his decision in minutes. So, with the record of going back to your COP, your chances to be placed in expedite removal are very high.

Besides, your asylum application in the U.S. is not longer valid, since you have abandoned without asking permission.

Dear abc7,

You say that you asked your friends if sending an asylum status inquiry was good or not.They told you not to bother them right?.Do you know that it is authorized to send a request of your asylum status?
Did you also questions to those friends of your if going back to your country was a good idea or not?
If they said yes, then be sure they don't deserve to be called by friends.
Another question, didn't you read what was written on I-589 receipt declaring that if you wanna go outside of the US, you must obtain permission to do so?
Pray that the officer at the import doesn't find out that your are an asylum applicant.
Waiting an asylum decision after 5 or 6 months isn't unusual, my cousin is waiting for about 5 months till then, security check according to what was told to us.....

my bro applied for asylum on his first ever visit to US and got 6 months visa at airport and applied for asylum after 2 months of entry. he came in SEP 2007 and has visa till march of 2008, and he applied for asylum in begining of NOV 2007 and has his interview on DEC,04 2007. after the interview m the officer gave him a letter in which it says his decision would be mailed but gave no time table when.

it's been just over 2 months now that he hasn't received his decision and his B-2 visa is expiring in mid March of 2008. in January 2007, after one month of interview, we sent an asylum status inquiry letter to the asylum office and they replied back to him with a letter of pre typed responses to asylum status inquiry. the one that was checked was his their answer and it was, your case is pending in this asylum office and you will be notified of any decision something. so it seemed like it wasn't due to security check issue
as that answer wasn't checked.

we sent a second letter in feb, 04, 2008, requesting for an update on his asylum decision and we expect to get a response in few days, but mostly, it wil be same letter that is yor case is pending on this office.

we just don't know when my bro will get decision, after his visa expires in marh 2008 or before or after few years?

its been over 60 days and no decision from AO office.
