Asylee with prior Illegal presence travelling

I am now an asylee for almost a year but before that I had 10 months of illegal presence. I would like to take a vacation after submitting the I-485 later this year but I am wondering if it is a wise idea since I would not have had a green card yet. Can anyone share their experience or what the rules are for asylees with prior illegal presence travelling with RTD?

You wouldn't have any problem. Just make sure to obtain RTD before leaving and you will need it to re-enter to US.

Yeah, once you adjust status, you'll be oke, right?

even before adjusting his status and getting the GC, he can travel using the RTD and enter USA using the RTD, previous illegal presence is already forgiven when obtaining the asylum status

Another question

Thanks to all for their suggestions. I have a few other related questions however so here goes:

1. Does the $1010 filing fee for the I-485 include the cost of the I-131 (Refugee Travel Document)?

2.If (without a GC) a visa is required for the destination (Canada),is it generally issued on RTDs?

3.If one applies for a waiver of the I-485 filing fees does that delay the processing of the GC?

Oh, by AOS I meant from ILLEGAL to ASYLEE. Is that not considered AOS? Yeah, I meant that after becoming an asylee, he'll be ok (with an RTD of course).

1. That's right, your first RTD and EAD are included in the filing fee.
2. Yes, visas will be issued on the RTD. Some countries don't recognise it though, and some allow you to travel on it visa-free.
3. I don't know.

1- yes

2- from the embassy page, click here and read about the refugee travel document requirments, if I'm reading it write, they are considering RTD holders "US temp residents"... funny

3- about 4 months delay, it is worth it if you are not in a hurry...

Gayguy,

If you were granted asylum status, you can leave and come back, there should be no problem there. I know someone with almost the same scenario.
EAD and RTD can be included in the filing $1,010 filing fee provided you submit applications for these along with your I-485.
