Hi, I just got my Green card this month. I was wondering If i can go back to parents COP. I am a asylee derivative. Me my brother and my mom got ours on the same date. My father hasnt recieved his yet, Why is that?

Green card - Got on jan of 2008 but it says card issued August 2007, why is that?

My question is,
1. Can i go to my fathers COP to study? Provided answer was a big fat NO.

2.Can i use my National passport to Exit the COP to go to the US?
I have read some post that Asylees cannot use their NP.
Is it the same for derivatives?
Answer: People said that its okay for Derivatives to renew passport and use it to Exit and enter the US
My Passport is expired already, Is it safe to renew it?
Answer: Yes it is

3. Will i have the privilege of coming and going out of the US like a normal green card holder?
No.

4. What does Back dated mean?

So when i become a US citizen it is going to be 2012 already? am i correct?

As an ex-asylee, you have to maintain your residency plus show that your GC wasn't obtained through fraud or misrepresentation. Getting a GC and then going back to COP is not a good idea for an extended period of time. Short trips are OK IF they are for emergencies. You have to remember that now you are a PR so you have to maintain your residency which means you can't be out of the country for more than 6 months unless you have a RP in your hand.

You may have no problems coming in/out of the U.S while you have your GC but during US citizenship time, the officer may question you a bit on COP visits.

TOO MANY PEOPLE STRUGLING to get an status in U.S.A and you want to jeopardise your life here after all your parents sacrifice to give you a better life? let me tell you..wait your citizenship and then take any desicion..just wait your time to be american and then ..feel free to do whatever you want..you are the lider of your life..have a good one
 
So i can't really go back to my parents COP? like 3 month long visits every year?
I've read a thread here saying that derivatives are treated/seen diffrently because we didn;t apply for asylum status ourselves.

Can you elaborate about the green card being back dated? I am not clear on this.

What you are proposing to do is doubly stupid. First, you will cause the government to have doubt about the merit of your parents' asylum application. Second, whatever academic degree you will get from your COP will not have the same value as a degree from the United States.
 
Visiting your COP, though somewhat tolerated, especially for derivatives, is different from living there for 4 years. Also, without a Re-Entry Permit, you will lose your GC status if you're out of the US for so long, even if you come back for a few days before each 6 month period is up. I've heard that renewing your passport, especially if you're a derivative, is ok, but, again, with the combination of things you'd like to do, and even if everything goes well until you finish your degree, your citizenship interviewer may have some tough questions for you. I studied abroad too, but only for 2 years, not 4, and it was in Europe, far away from my COP, and I never renewed my passport, and always had either an RTD or an RP, and I did come back to the US as often as I could, and never spent more than 5.5 months outside. Even with this pattern, there's a huge risk of being denied citizenship when I apply next year, so I will have to do my best to write a letter explaining the circumstances. What you are trying to do seems even MORE difficult than what I did, and I wouldn't advise it. Either way, good luck.
 
Going Back to COP

I want to second Thankful on his ideas. I think the decision is yours ultimately to make but you have to bear in mind that you could be potentially putting your parents at risk as well as yourself. Are there no schools in the US that offer the program that you are interested in pursuing in your COP?

Well, I think thankful could have been more tactful, but let's just say it wouldn't be too prudent. Is there a specific reason you'd like to go back to your COP? Do you REALLY have no fear of going back?

Asylee Green card

As I understand it ( I stand corrected), you are eligible for citizenship 5 years after the date of the green card. since the green card is back dated one year for asylees it means that you can apply for citizenship 4 years after you actually get the greencard, not 4 years after the effective date of your greencard.

If the date on the gree card says "2006" + 4 years = 2010 i'll become a USC?

Its backdated because of that one year that you have been here as asylee.
So all together you do wait 5 years before becoming citizen. (starting from the day you got approved for asylum)

So, as an asylee since 2000, it'll be 10 years or more by the time I get citizenship! I wish they backdated the GC for asylees like they do for refugees- the date when asylee/refugee status was granted. Either way, it shouldn't be long now, so long as they approve my case.

The five year from the date of asylum grant was the ideal when Congress passed the Refugee Act. And it got screwed up when the number of people granted asylum far exceeded the 10K cap. Now this is much closer to reality.

Refugees get better treatment because unlike refugees they are brought to this country by the United State Government.

So the answer is i get to apply for USC after 4 years.
So when the Date written on the card says Aug of 2005 then i got it on Aug of 2006. I get to apply for USC on 2010. Got it. thank you.

Another question

For example i got my Green card at Aug of 2006, but it says that it was issued on Aug of 2005. Will i able to Go abroad? Cause i read that i needed to establish 1 year of residency in order for me to travel abroad. i am confused because my card says issued Aug 2005 but i got it Aug 2006. Do i still need to establish 1 year of residency in order to travel abroad?

I am just merely asking, I didn't say i wanted to go back. Knowing details isn't bad is it? :eek:
