Lost W2

Request your company to send u a duplicate W2.
If they are not co-operative, just send them an email and keep a copy of the sent mail.
By law they are required to send u a copy within a reasobable time frame and most companies do not mess with this.

You can also make that request to IRS if you had filed your tax return for 2000. Go to following website and follow the instruction.

That depends on your type of employment. If you are an independent contractor your company would issue a separate 1099-MISC which you need to file with your tax return.

If you don't get any 1099-MISC don't worry, your company might have included it on your W2.

You can goto the local IRS office and request your filing statement.

But for my other question, per-diem is not shown in my W2. Would it still be considered as a salary package by INS.

You should probably talk to your employer and confirm about it. They might give you a separate 1099-MISC. And it might depend on the accounting practice of each company. Some companies include Per-DIEM as their own expenses while filing taxes.

If you have not received it on your W2, USCIS will not consider that as a part of salary package. Per_DIEMs are usually considered reimbursable expense.

Nothing Going on for the April 2003 file

What would be a guess when the I140 would get approved for some one who filed in April first week.

Please make an approximate estimate based on your experience with the Immigrationportal community.

You mean without RFE when will be the approval for April 2003 filers. I guess it will be somewhere 3rd week of February to the anniversay date of I140 filing.

I will be sending my papers for EAD renewal next week. Let me see if it triggers something for I140 approval.

I don't use EAD either, however, I plan to renew it, if possible, by myself.

One question though: since my 140 & 485 are filed by my company attorney, can I still renew my EAD by myself? or I have to do it through the company attorney?

Can do it your self. Not even necessary to mention any one including your company. Refer/ Search this web site you will get all necessary things you need to do.

It can be done without attorney. Just make sure all the documents are in place so that unnecessary RFEs are avoided.

Between thanksgiving till Jan 3, I lost 6 precious working days due to the holiday season.

I guess for guys like me, holiday season really starts only when INS folks start working on a normal schedule(instead of the current holiday pace at which they are working even on regular working days) and process our Immigration petitions.

It is during such tight situations that one needs the best wishes of others the most. You never know whose wish may work for you. So I also wish, you would be out of the tight corner soon.
I am also in somewhat similar situation. Not from vacation or low rate prospective but because of missing on so many good oportunities. Can't take salary rise, can't get promoted and can't underperform. 140 is still pending and GC..very long shot. Do not know how would I hold my company from not increasing my salary or position...I have already refused 2 promotions and salary increments????
The whole situation is very depressing. Others who perform less than me me would moveon and I would be left behind..Do not know what to do???:confused:
