Please update me when you get the response from FBI regarding Name check. Our applications are with the same office I guess considering the finger print, RD, I140 approval/processing dates etc. (i got RFE on I140 in April).

In my case I got a response from FBI stating that 'No Records found'. that is USCIS hadn't requested name check from FBI. It looks like some of us (in April 2003 RD) missed name check boat of USCIS. Hope for the best.

I got lack of manpower reason while you got service consideration 120 days more. I guess they have requested name check recently...in that case I will put in another e-mail request to FBI soon.

I will surely inform to you once I get the response from FBI name check. I suspect my name check also pending with Fbi just like you. I hope we will hear good news by the end of this month (this is my dream only).

I emailed FBI twice but no response to date. So, I am sitting trying to guess if my namecheck is done. Does the fact that an RFE (W2,paystubs,EVL ..) was issued against my 485 imply that my namecheck was done? Just wondering what others' thoughts are on this.

As I said in last post. The response to my 485 status inquiry is "delay due to the Security check.....".

It will be highly appreciated if you guys can give me some hint on how to fight in this senario. How does one know when is his name check is sent to FBI? I have sent an email and a FAX to FBI about my security check status on Dec 2 and, of course, no response yet.

Can I initiate some expedition process request to FBI? Can I contact Congress man to put some pressure on the case? I remember seeing some Congress man list somewhere.

I have an update on my case. My RFE was recd by VSC yesterday. Also, I got a response from Mr. Hardy (FBI) to my email sent on 10/14/2004.

I called FBI Voice line yesterday,
They are not accepting FAX any more... only email.

As per VSC.. my name check was initiated on Dec 5 2004,

Looks like April 2003 got messed up..............
 
VSC forgot to process April 2003 cases

The response to my 485 status inquiry is "delay due to the Security check.....". and my LUD didn't changed after starting status inquiry.

I haven't got any response back from FBI for the email inquiry made on Oct 22

How to get information from VSC that my name check was initiated and if so when ??

They told you to wait 2-3 weeks for response by letter?
If yes then they response or not ?
what was response ?
 
April 2003 and still waiting...

When I called up few days back and followed the tips given by someone in this forum to speak to VSC person on phone, they told me that its awaiting security clearance. I sent an email to FBI last week and am now waiting to hear from them. I hope USCIS has screwed the April 2003 filers.

Has anyone seen any April 2003 485s getting approved...

Why would you "hope" USCIS has screwed the April 2003 filers? :confused: :mad:
I guess you meant "I guess USCIS has screwed the April 2003 filers". :)
 
I called Fbi regarding name check they said they are processing october 2nd week requests currently. I did fax to them on Oct 12th 2004 and oct 29th 2004 (no use for faxing) .I got to wait 2 more weeks to get the response because I have send email request on Nov 2th 2004. Status Enquiry response from INS was Pending service consideration please allow 120 days to get the response. I guess April Filers got screwed up.

You probably are correct when you say they are processing "october 2nd week" requests. I sent an email on 10/14/2004 and I got a response yesterday.

Yeah Hakoona, I meant I hope uscis has NOT screwed April 2003 filers. Does anyone have the latest analysis for April 2003 filers ?
 
response to status inquiry

Just go back from vacation, and got a response on my status inquiry request:

"The processing of your application has been delayed. All petitions/applications received by this Service are required to have routine security checks that are resulting in the delays of the adjudication of petitions/applications. As a result of the lack of manpower to complete the checks I a timely manner, we have no control over how long these checks will take. We can give no definite indication on when they will be completed. We apologize for the delay."

Going to email FBI next.

In the mean time and more importantly, my I use this opportunity to wish you all a happy and successful new year :)
 
Updated statistics for ND 1 Apr 2003 cases

Here are the updated statistics (as of 4 Jan 2005) for I485 applications with ND 1 Apr 2003. The changes from my previous scan on 17 Dec 2004 are indicated within paranthesis.

Initial message: 81 (-5)
Finger print received: 70 (-4)
Responded to applicant request: 17 (+0)
Outstanding RFE requests: 12 (+2)
RFE responses: 10 (+2)
Reopened: 10 (+0)
Transferred: 88 (+3)
Miscellaneous: 3 (+0)
Approved: 2 (+2)
Card ordered: 6 (+0)

Both approvals had a FP date of 23 May 2003 in the online status message. I am guessing that they received a second FP notice but the online status was not updated.

A theory: Based on some recent posts by 1 Apr 2003 filers, it appears that the name check is complete only for those who received an early FP notice. I think the name check has not been completed for filers who received a late first FP notice (after Aug 2004), and hence the delay in their approval.
