AP Q: What is class of admission?

Hi,

I'm filling up the new AP forms (for renewal) and there is a category "Class of Admission". What do I fill in there? The form itself doesn't have any explaination for it.

What it is
I talk with a immigration officer today and he told me class of admission is the status of visa you enterd in USA.
 
No class is what you hold now. If you have used H1 to enter US, but are using EAD, then it has to be I485 adjustee.
 
It is better to explain on cover letter attach cover letter for your AP, it makes easier for the officer to know if you miss any column or write wrong info. Because many are not clear actually what they should write as "class of admission" you can also write on the cover letter that you entered on H1b status last time to US or on H4 visa to US. Write clearly that I-485 or AOS pending EB based. You should sign your cover letter with date and address

I think this is right and makes sense.
If you take a look at entry stamp on your passport, it says CLASS and immigration officer writes "H-1B" next to it, (if you entered on H1B) so that shows the class of admission. If you last enetered on AP then it would be Parolee that I am not sure. Anyway you will be sending copy of I94 with the app so Class on both doc should match.

If class of admission is how you entered the country last time, my case is going to be all the more complicated. I'm travelling out of country in end of december... and will be entering the country back on AOS while I entered the country on H1B last time.

Should I just apply for AP after I come back?

I dont know dude, better talk to a lawyer.

If I have a long valid H1B visa on passport and have not worked on EAD (thus in H1B status) I wont be fret for AP much as H1/L1 guys can travel on Visa while AOS process is pending. And you will not be entering on AOS unless you use AP if you use H1B next time you will still be in H1B status which should not harm your AOS process as H1 is a duel intent visa.
 
This gets worse now...

my husband entered the country on F1 last time. he changed to H1, lost his job. found a job on EAD. now, we are leaving the country and he will be entering the country on AOS. what would his class of admission be ?

I will try to enter the country on H1... that would make my life easier. :)

'Class of Admission' is manner of your last entry at the time of application for AP, how do you enter after applying doesn't matter.

Hope I didn't confuse you.

If your hubby worked on EAD, he should not leave US before receiving AP, unless he has H4 to re-enter assuming you as primary AOS applicant and on H1b.
But if he enters on h4 and you on H1B his status will again become H4 and after waiting some time he can start working on EAD again which will change his sts again from H4 to adjustee.

Even in case of AP, also confirm before you leave and make sure, if you are a primiary applicant and he is as your dependent in AOS, that you can enter on H1 and he can enter on AP simultaniously this is kind of complicated situation.

If he is a dependent, he can enter in whatever class he wants and is eligible for; it has no bearing on the primary applicant's case. He can enter on AP and the wife on H1, but he cannot use an H4 if she is using AP.
