Hi All,

I got the approval of I 130 for my mom.
Now I can apply I 485 but I want to know couple of things....

1. which one is faster and safer CP OR AOS?
2. If I file I -485, then can I apply AP also if incase my mom wants to go?
3. AOS - For parents what is the processing time?

Please help me to decide what I should go with CP OR AOS to answer these questions.

Please help me to decide what I should go with CP OR AOS to answer these questions.

1.If she is in Country AOS would take about 3-6 months, is faster than CP.
2.Yes, if you send AP together with I-485 is also free (you get document in 3 months or less.)
3.Most cases take about 4 months and no interview.

Good Luck!

Not necessarily true. In some countries, having an already-approved I-130 makes the CP take less than 3 months.

But two facts of particular concern here are whether his mother is currently inside the US, and whether CP was requested on the I-130. If CP was already requested, it probably would be faster to just continue with CP now that the I-130 is approved. And if his mother is outside the US, trying to enter the US to pursue AOS is likely to be a problem, now that she has an approved I-130.

Thanks for replying my questions...

Jackolantern, to answer your question:
My mom is in US and her Visa is valid till Dec 2nd.
And I have not requested the CP (I believe you mean to say to apply I 824) correct? I had applied ONLY I-130 which got approved yesterday only.

Based on BribeAl response it make sense I should apply I-485 becasue this would be faster than CP as my Mom is already here...

I have used US address in I-130...
And in the approval notice, it's mentioned that since she is in US that's why she can apply I-485. And if she wants to apply from her country (which is India) then she needs to apply I-824.

Do AOS - it's faster (although some won't agree) BUT it's DEFINITELY less paperwork - however it costs a little more.

yeah! then you have to do AOS, it will be fast, so nothing to worry!
(you can still do CP, but you have to request the change to CP and it could take some time)
Good Luck!

Great!!!!
Thanks everybody...

I will go with I-485 option...

One more thing I want to share...
My Mom doesn't have birth certificate but today I find out that we can get one from Indian Embassy US office also...
