Anyone file PERM today?

Hi, I am very new to perm. Currently I am on H-1B visa for 2 years and my company is very small and have not ever filed any GC before for anybody. Its a small software company 7-10 employees. Does that affect when applying for GC ? we mainly do US state govt and few foreign govt software projects.

my other question is, what is the best idea to file for GC ? go with a lawyer or do it yourself ?
what I have understoon reading this forum is , you can do part of the process yourself and then hire a lawyer to do the rest ? correct me if I am wrong.

Request for information on PERM status?

Hi Folks,

Its been a couple of months since I had filed for PERM, not much response from my employer nor the law firm they work with. I would be pleased to know if there are any PERM websites I could check my status? I would greatly appreciate any information.

Today we have received the hard copy of the certified 9089 application.

Case was approved on 09/16/05
Hard Copy received on 09/19/05

when can i file my PERM? :confused:

You need to ad for 30 continuous days and wait for 30 more days after that. Base on your information, it seems your company have not complete the 30 days ad.

well.. this is what i thought.. (30 days ads + 30 days waiting) but my lawyer think otherwize. (10 + 30) do you have any good inforamtion on that? i just can't get it from the DOL info. :confused:
 
PERM form questions, planning for re-run

Hi Gurus,
My lawyer filed my PERM application from Chicago on Aug-10, EB-2, BS+5. I did not agree with 2 answers and am wondering if someone can help me understand.

Q - F.6 - Prevailing Wage source.
A (Lawyer's) - OTHER. (DOL-IL as they got PW from there)
In my opinion - "OES". As the PW form they got back from DOL-IL says "wage source" = OES

Q - H.8-A - Alternate Education
A (Lawyer's) - OTHER. (Bachelor's with 5 yrs of progressive experience)
In my opinion - "BACHELOR'S". As this is the education question. The alternate experience is asked in H.8-C

I am taking this form to be like TAX or any other forms that we fill. We clearly specify where the question has any given choice. Please tell me from your experience if Lawyer's answer is correct or my opinion.

Congrats on the PERM approval. The USCIS says that it takes 45 - 60 days before a decision is made. Yours appear to be more than 60 days. Any reason for that?

FYI, my PERM was "approved" on 09/13 from Chicago, now I'm waiting for the hardcopy. Filed 07/12, EB2, MS+1yr exp., non-IT Engineer, O*Net Job Zone 5, SVP 8. No business necessity (H12=Yes). Employer and attorney have kept mouth shout: case number unknown.

After a long research over the internet, I found I can proceed with the seemingly risky semi-concurrent filing of AOS if the LC hard copy doesn't arrive timely: efile I140, courier the I485 application w/o medical exam before the dreaded October 1st retrogression.

I was considering proposing for George W. Bush to buy back my house at market price in exchange for my immediate departure from Uncle Sam's when the attorney's paralegal called me. To be rich, I don't have to be stuck in America: gold shines wherever it is. This country is addicted to illegal aliens to fight inflation: Mexicans lawn men, Chinese human-snake cooks, middle-east terrists, and other 245(i) beneficiaries who have long since kidnapped my non-RIR EB2 case with a late 2001 PD in DBEC.

This forum is very informative. Good luck to all those in an honest pursuit of qualify life.

I think, efiling I-140 and mailing I-485 will not be considered as concurrent filing(It is my personal opinion and i am not a lawyer). I am also in the same boat. Thinking of applying I-140 with PERM approval screenshot along with I-485. Since they have secondary evidence of labor approval they cannot deny it without an RFE. I am planning to pursue this path. Let me know what do you think.

I think it "semi-concurrent". Some site says one needs to include with the I485 application the supporting documents that were efiled with I140. Given that fact a lot of folks with PERM approval mentioned they were waiting for the hard copy, I don't have 100% confidence on this path. However, I'll have an appoint with my attorny next week for the right solution.

Continue with EB3 or file fresh EB2 under PERM

Guys,

I had filed for my labor under EB3 category in Aug 04. Did not bother much about the category etc as MA labor was just a year back then and we all decided to go through a channel that offered least issues. I had BS+5 years of experience before joining this employer.

Now with the 485 retrogression and with the BECs just dragging their feet on labor approvals I thought about applying for labor through PERM and also change my category from EB3 to EB2. I know I would loose on my PD but I think I can make up for that since EB2 is 18 months ahead of EB3 (layman's calculations though).

I got my HR and manager buy into this but our attorney is just not buying into it. He feels that loosing the PD is the "worst thing" I can do to my GC and he advised me to stay with my current petition. He also said that not all service centers consider BS+5 eligible for EB2 (which I've never known to be an issue before this conversation).

So my question to the group is

1. Do you guys agree that I should relinquish my current PD and apply for a new one in EB2 category under PERM.
2. Is BS+5 a valid criteria for EB2?
3. Is the EB2 queue for 485 expected to move any faster or at least at the same speed as the EB3 queue? If yes then are there any sites that can give me stats that I can show my attorney and turn him around.

I think you can file for a different position under EB2 category and that way not lose your eb3 PD.
since all eb1, eb2 and eb3 are retrogressed, it may not matter much. if one of the pending immigration reform bills get cleared and unused numbers become available, then all the three categories may become current.
so you can consider your options.....

How long from In process to certified?

Can someone pls give an idea how long it takes to change the status from "In process" to "Certified"

Labor got approved

My labor got approved on 09/13/05

Here are my case detials:

Filed on 08/16/05
Category EB-2 (Software Engineer)

I will be filing my I-140 and I-485 before 09/30/05. I'm waiting for my hard copy of labor certification.

How long will it take to get hard copy from Atlanta ceter?
Please post me if any one got hard copy lately.
