I just filled I-485 this week with my Wife and Child(They are on H4)and next week I am going to Visit Canada. My question is do I need to apply for Advance Parole ? We are a Canadian Citizens.
So long as you are satisfied that the I-485 has been received by USCIS, they can return merely by providing evidence of your H-1 status and their relationship to you. They should bring a copy of your H-1 I-94 and a copy of their marriage/birth certificates.
We all are here in U.S and we all are going to Visit Canada next week.
If you haven't received the receipt yet, why do you think you'll get AP in the next few days? If you're satisfied that your I-485 package was received by USCIS already, you'll be fine.
Besides, if you filed an EB I-485 on July 2nd, it'll probably get rejected anyways. There's no problem re-entering on an H-1/H-4.
One more question do I need to apply for AP after receiving receipt from the USCIS for I-485?
I want to obtain EAD for my Wife ASAP, I would appreciate any help with regards to the above two questions.
You should have applied for AP along with your I-485. If you want to apply now, you need to wait for your I-485 receipt.
But you don't need it to travel.
