Advance Parole for Canadian Citizen

Hello,

I just filled I-485 this week with my Wife and Child(They are on H4)and next week I am going to Visit Canada. My question is do I need to apply for Advance Parole ? We are a Canadian Citizens.

So long as you are satisfied that the I-485 has been received by USCIS, they can return merely by providing evidence of your H-1 status and their relationship to you. They should bring a copy of your H-1 I-94 and a copy of their marriage/birth certificates.

We all are here in U.S and we all are going to Visit Canada next week. I filled I-485 on July 2 2007, but still not recd. any receipt or Acknowledge for Acceptance or Rejection. Do you have any idea about Advance parole in this sitution.

If you haven't received the receipt yet, why do you think you'll get AP in the next few days? If you're satisfied that your I-485 package was received by USCIS already, you'll be fine.

Besides, if you filed an EB I-485 on July 2nd, it'll probably get rejected anyways. There's no problem re-entering on an H-1/H-4.

Thanks for your reply. One more question do I need to apply for AP after receiving receipt from the USCIS for I-485?

Question

Background:

I am a Canadian working in Arizona under TN status and my Wife has TD status.

Questions:

1) If I file my Labor Certification (Electronically) in July 2007 and everything goes right is it safe to say I could have my LC approved by October 2007?

2) If my LC is approved by October and EB-3 "All other Countries" is current can I file my I-140/I-485/EAD and AP in October?

I want to obtain EAD for my Wife ASAP, I would appreciate any help with regards to the above two questions.

Does Canadian H1b with I-485 pending need Advance Parole?

I'm in a similar situation with OP: Canadian citizen, H1b holder with I-485 pending for two years (EB2 based). The AP instruction says if your are in H1/H4 and I-485 pending, you don't have to apply for AP as long as you can present the H1/H4 visa upon returning. Does if mean I don't need AP to return as long as my H1b is valid? Will it jeopardizes my I-485? Thanks.
