And yes, we all know the process with the name check is messed up.

Let's say I am a terrorist and come here to do something bad. They will let me travel (AP) and allow me to work (EAD) and to drive (DL and SSN) way before they find (through name check) who I am... for months or years... :p Makes no sense...


What you guys are forgeting is that the US legal system operates on the premise of "Innocent till proven guilty", and that probably is a fair way to proceed. There are more people who have good intentions in this world, that those with bad. So if you came here to be a bad boy and the system lets you do as you please for now, don't think it wont catch up with you eventually. If it never does then good for you. We can't let a few bad men screw things up for the well intentioned. But by and large the economy benefits from allowing people to work as their status is being adjudjicated. Its also called fairness. So Tommy_Chicago chill out & wait your turn, I bet your home country isn't as welcoming.

So how come USCIS treates you as "potential illegal immigrant" when you apply for a visitor visa at an US embassy overseas or apply for entry at a POE? :rolleyes: basically you have to convince an IO that you are "innocent" of a future crime :p

No they aren't like that. I think the problem with us immigrants is that we are impatient, and we think we deserve to be in the US, and thus the govt has to act swiftly to grant us papers, and yet it doesnt have to always like that. You know the law could be changed over night and this marriage based green card could be gone? In some developed countries, marrying a citizen doesn't guarantee much.

In short what a I saying? NOTHING :D

You DO have to convince the immigration officers that you are innocent though. That you will NOT illegally stay in the US. The "innocent until proven guilty" does not apply with USCIS.

I wonder if we can bring our own recording device or Camera to the interview just to have a record and proof just incase if something goes wrong, to have how the interview go, you know some people say that these immigration officers are not nice at all, may be this will change the way the treat people.

But anyways, I got my AP Document in the mail today! :D :D :D

It is 2 copies... the same document. I checked multiple trips when I was filing the form... so anyways, I will post a scan tomorrow from my office :)
 
Because I checked the "multiple trips" check box when I applied for it. Meaning I need to travel more than once outside of the US while my GC is pending.

Also, I am guessing because they keep one copy at the POE when you come in and you keep one to show your IO at the Interview (as it is mandatory you let them know that you used AP).

Have you decided to file it or not?

PS: The AP is printed on heavy paper, like every NOA you have received, it also has a Dry Seal stamped on the photograph square, it is a round seal with an eagle and it reads Department of Homeland Security

I wanted to file for marriage base green card I-130, I-485, EAD and AP. Can I fill on my own or should I hire a lawyer. I contacted a lawyer he said he will charge $5000. Please suggest!

But you can do it on your own, most of us have... do not waste $ 5000 unless you have a complicated case. What is your situation?

Give me $1000. I will file it for you. Just kidding.:) Don't waste your money on lawyer. Unless your case is complicated, it is very easy to file the papers. But you have to read a lot. I suggest you start with one of the Sticky threads on the first page.

These are the forms you need to File.
I-130, I-485, G-325A, I-693, I-864.

Optional: I-131 and I-765

131 and 765 are AP and EAD respectively. They are not required to be filed for your GC. But they can come in handy if you are waiting for a long time for GC and need to travel or take up employment.

Download all the forms and start reading. Its a lot of work. But it saves you $5000. :cool: . So get to it.

After going through all the forms, if you have any specific questions, post here. Someone will try to answer them.

Fill out all of the forms yourself if you have any questions ask us - no need to spend your money. Do it quick before all of the fees go up.
 
Well, here we go again.... After reading all the info and need to travel in Sep. 2007 I can not risk of not having the ability to leave the country and come back I've sent out the travel documents again :p Hopefully it they will approve it and $170.00 is not expensive at all. If we get the GC before traveling then be so.
