hi Everyone
thank you for any feedback.
(sorry, if I post the question in the wrong form :( )

I just received my conditional GC.
My sister currently is studying in Canada, she is looking for jobs around US.
Long story short, she asked me to help her to file GC application.

1. I am not sure if I am even eligible to file for her.
2. Will she be able to work during the application in process in US? Will she be able to travel outside of the country? (I hear she has to wait 11 years :( so that is very important )
3. If I can't file for her right now, will I be able to when I received my citizenship? Will she wait less?
4. Will it be better if she moves back to our home country first and wait for the application to process?
5. Does she need to have H visa? or Once we file the applications she won't need any visa?
6. Her job is paid by case, and usually only have one year contract---that is why she doesn't think she will get H visa (because we hear usually needs at least 3 years contract to received H visa) Is there anything we can do to help her get H visa?
7. Because her case will have a long wait and she is young. Will that be a problem if she get married during the application is in process?

very confused...because I am not a law friendly person and I didn't expect this coming at all. So...any help will be appreciated.

Greencard holders cannot petition for their siblings, unfortunately.

Even after you get ur citizenship, it still takes forever for a U.S. citizen's siblings to get GC. The current wait is about 10 to 20 years.

4. Will it be better if she moves back to our home country first and wait for the application to process?
if she can't stay in the States legally, she needs to leave - doesn't matter where she's going to be.
5. Does she need to have H visa? or Once we file the applications she won't need any visa?
once you become a citizen, you'll file I-130 for her. It will not provide her with any legal status in the US. She'll need to maintain her own, which will be difficult since the minimum wait now is about 12-14 years.

6. Is there anything we can do to help her get H visa?
get her an employer?

7. Because her case will have a long wait and she is young. Will that be a problem if she get married during the application is in process?
not a problem.

thank you so much for all the help

I have a final question
My sister has an employer. However, because her work is often by case, therefore, the contract usually signed yearly.
She said, her employer told her "they filed several cases before for their employee but the application did not pass."
Is that because they only sign one year contract?
So if her employer willing to sign a 3 year contract, it often pass?

sorry, to ask this in a wrong forum. I am almost done

H1 is for temporary worker and I don't think 1 year contract should be a problem as long as she gets prevailing wage every month. They may need to make employment period on I-129 and LCA for 1 year instead of 3 years if contract is clearly a yearly basis and need to extend yearly.

I guess H1 rejection is for different reason.
