6 yrs h1 near ending, 1 month before H4 stamping

Hi All,

My H1 6 YRS are ending in sep 05. i filled for labour just 2 days bfr one year i.e. in sep 04.

Answers reqd.

1) Can my wife go to india (she has a valid h4 till sep 05) to india in June and get her h4 stamped in the consulate and come back in aug end.
2) Is it a good idea to go after all?
2) when is the right time for me to apply for my h1 extension? Any chances of rejection etc?

You cannot apply for 7th year ext. before completing 365 days from your LC filing date. So the trick will be to have the whole application ready for H1 / H4 ext. Send (overnight) it the day you complete 365 days so that when USCIS receives it, you have completed 365 days and your H1 is still valid for one more day. Otherwise there are chances for rejection.
Regarding your wife's going to India, the problem I see is that the she may not be able to get her H4 stamped for such a short time (less than 2 months). I am not sure about it, wait for other members to respond also.

2 days exactly before expiry of your current h1. If you apply earlier than that your H1 will get rejected.Reply will highly appreciated.

My wife stamped visa has expired in the Passport. But she has a valid H4 till sep'05. Therefore she has to get her visa stamped at the consulate before entering the country.

Any more views would be appreciated...
