485 transfer to Phoenix local district

I would suggest that you go there and talk to them. I am planning to do this for my case.

One other guy I know got his interview letter this week. His date was in Oct 2001.

One thing which is confusing that they've sent bunch of forms with the letter. Even though he is an employment based case he got forms which are needed for family bases cases. Also, he got a medical form whereas the letter alongwith the forms has no mention for a second medical test.

Do we need a medical again if we go for an interview?

I am thinking that our interviews are right around the corner and we should start preparing the documents needed.
 
Yes, I am planning to go there next week. We may have to do the medical again since it has been a long time after we did our first medical test.

I do not understand the other forms.

I understand that we will need to show proof of marriage etc.

I was thinking that I won't get a letter until the dates move to Nov/Dec
2002.

I had sent an email to my lawyer this morning and his response was:

Generally the local offices' priority dates are dictated not by the
original priority date, but by the priority date that your case was sent
to the local office. Do you know when your case was transferred
vis-à-vis their cases?
 
Good morning Pears & Phoenix_us,

I got the interview letter last week. I applied in Oct 01 and got the notice in Nov 01. My case was transfered to Phoenix in Jan 03 and now I got the interview letter.

However, there is one strange thing. We got the interview letter just for my wife and not for me. I am the main applicant and she applied as my wife. So I am not sure what's going on. Is it possible that only wife will be interviewed and not the husband?

Should I go down to Phoenix office and ask them? :confused:

Do you have an attorney. I would suggest that you send an enquiry thru your attorney. Our dates are prior or close to your dates but we have not received interviews letters yet. I started thinking that maybe we won't get it until dates move close to our transfer dates. My attorney has the same opinion.

Talking to the people at counter in Phoenix INS does not help much. They usually don't have right answers except you will knowing that any correspondance has been recently mailed or not.

What is the interview date for your wife ? Have they requested lot of documentation for her.
 
I just called the 800 number and they say it is possible that me and my wife will be interviewed at different times. Since I changed companies, I don't have an attorney now. So I don't have a way to verify that this is true. I will go to Phoenix office and ask them.

Not a whole lot of documents were requested. It was very generic in nature. Mostly preprinted forms and things. Though what surprises me is they included forms required for family based cases and also a medical form. So I think we will do a second medical test just to be on safe side.

Can you ask your lawyer if it is always required to have a second medical test for interview cases and if both applicants can be interviewed at different times?

I have sent an email to my attorney and gave his details about your case. I would say just go for medical test 2nd time. It won't hurt.
 
My lawyer said:

Those local consulates are crazy. They do not take phone calls. Perhaps you could go down and ask some questions. In the past we have had cases in which husband and wife were interviewed at different times.

Isn't there anyone else who had an interview at Phoenix district office?
 
Now my interview has also been scheduled. I asked them about medical and they said that medicals expire in one year (that's new to me), so it is better to get one done. They also said that I can come to interview without medical and if they ask for it I will be given time to get it done. They might not even ask for it.

I would rather spend the extra money now and not delay the approval process any longer.

Any news on you guys?
 
Income Tax returns

How do we get the copies of Income tax returns? I called the IRS number and they say it will take more than 60 days to get a copy of return. The transcript would be available sooner. Is there a way we can do this in person?

Did you guys go to local office to ask about your cases? I would recommend it because if they mail a notice and you don't get it, you get denied automatically. Just a word of caution.
 
My CPA files my taxes and he has a copy of all my tax returns for previous years.

I went to the Phoenix office and they told me that they have not sent a letter for me yet.

Can you take some time and post the list of the documents that they have requested for the interview.

This will give us some lead time to prepare the documents.
 
They were not specific in asking for docs. I have seen msgs for other centers that they ask for particular docs but that is not the case here.

First letter is very generic and few boxes have been crossed. One says that if you don't come on this day your 485 will be denied. One says that the primary applicant needs to come for sure. There are two other boxed checked (I don't remember exactly), but they are for simple things.

There is one other page which is a xerox of a xerox and again its very very general. It talks about certain docs for family based applicants. It talks about medical exam (which I got done again). Talks about Income tax papers and certified copies of court docs.

So overall it is very general. Nothing specific has been asked. I will enter more info here today evening when I get home.

To answer your other questions. Yes, I changed job after 180 days and no I am not planning to take attorney with me. I don't have one and if hire a new one at this time it will cost mucho bucks. If there is a problem they usually give you time to get docs and stuff.

Thanks for the detail information. Good luck with your preparation and interview. I heard from few people that it is usually very general and if
you are lucky you will be out in less than 30 mins.

I have a question. The packet I got has a form I-864 (Affidavit of support). Isn't this required only for family based cases? Or do I need to sign this for my spouse? I don't think it applies to employment based cases but just want to make sure.

I tried to search the board for "864" and got a few threads but they were all family based. Does anyone know if I will need this?

I had to submit an Affidavit of Support for my dependents when I filed my employment based 485. I did not have an interview though, case got approved from CSC. Hope this helps.

I received my 3rd finger print notice last week. I had gone for my 2nd FP in January, 2004.
