Dear friends
I have recieved RFE CRIS emails for pending 485 for me, spouse and kids. What do you think that one is about? Any recent experiance please? You know my 140 is approved recently. Retrogression is also 2004, my PD id Jan 2007. I have recently applied for EADs, my wifes approved and mine completed finger printing. Every thaught is highly appreciated

Could be anything, from additional info needed for EAD to Birth Certificate query to proof of recent employment/verification etc.

Wait for the RFE to reach you/attorney. No use speculating this early, without having the RFE in your hand.

I have my H1B valid until 2011. I am travelling this summer and get my passport stamped in my home country. If my 485 is apporved during the time when I am in India, does it effect my re-entry any way? Do I have to have I-131? Do I have to have actual cards? Thanks for your response.

I recieved RFE today by mail. In short USCIS is asking supporting documentation that continued to be engaged in the occupation that is the basis of NIW.

"The documentation can include but not limited to ....recent publications, current letters from employers, copies of recent and or ongoing publications or reaserch, copies of recent awards, grants or fellowships etc., or other such documentation confirming that you intent to carryout the terms and conditions of underlying form I-140 petition"

As I stated earlier, I donot have a lot of publications. It looks like an other 140 for me. I read lot of people just say submit your W2s. But, I am worried about the longuage in RFE. Is this common? I just need to show I am continuing like submit w2s and letter from employer? or I need to have awards and publications? I can submit letters from current employer and some other supporting letters from the people participated in seminors.

Send the followings:
1- Three letters of recommendations from different scientists (different than those who wrote the original letters) describing how important your research is and how the scientific research will be adversely affected if you quite.
2- Letter from employer with the level of salary (I assume it is the same field to that when you applied)
3- Recent pay stub.
4- Any recent abstract, meeting attended or paper published recently and not included in original application.
5- If you can enroll in 2 or 3 scientific societies and have certificate with membership will be good
6- Write a very nice cover letter discussing what are you doing and put a lot of scientific terms (10-15 pages)
7- Collect your documents and take your time (to the last week of the response period).
As you said, it is like a new I140. One of my friends got a similar RFE and I did with him almost the same and it works at least with him.
 
This is an RFE for your I-485, not your I-140. So you do not need to submit evidence that you are qualified for the category (that's already approved) but you need to show that you're working in the field. So a letter from your superiors explaining that you are continue to work in your field as well as a short description of current research and accomplishments is needed, as well as some of the items they listed (but not all of them, only what you actually have). Recent poster presentations or seminars are also good. These need not be too detailed because, again, you've already gotten your petition approved. This is just to show that you're still working in the field.

Sometimes, just a letter of verification of employment as well as research description from a department head is all that has been needed to to fulfill these types of RFEs.

Thanks for your input. I will try my best to collect letters. I donot know if I will be able to write covering letter of 15 pages as I wrote everything about me in 140. Probably I will try to copy some from there. I will go in the middle of you both.... you both sound reasonable....

A 15-page covering letter is an oxymoron. Just provide evidence that you are still working in the same field as mentioned in the I-140; you do not need to reprove the NIW part.

Dear friends

Thank you for suggestion. I mailed my packet yesterday. My packet includes 4 pages covering letter (I did not expect I could fill 4 pages), letters from my employer and head of the dept. stating my study, supporting letters (kind of recommendations) from three other colleagues, evidence of my long term association with the area I am working (about 15 years, kind of experience verification), handouts made for new seminar, recent pay slips and w2s, new certifications etc.,

I did not make a new I-140 but I put every possible evidence I could think of for proving I am in the job and will continue in the field.

Anybody has any experience or idea, how long it might take, before they take decision, after reply to RFE?
